A resident reflected that the couple currently has a Certificate of Land Use Rights, but there is no housing information on the certificate. This person wondered whether that case would be determined as not owning a house to register to buy social housing or not.
Answering this content, the Ministry of Construction said that the conditions for housing to buy social housing are currently regulated in Article 29 of Decree No. 100/2024/ND-CP, which has been amended and supplemented by Decree No. 54/2026/ND-CP.
According to the Ministry of Construction, the case where it is determined that there is no housing owned by them is when the person registering to buy social housing and their spouse do not have a name or no housing information content in the Certificate of land use rights, ownership of assets attached to land in the province or city where there is a social housing project.
Thus, if people's spouses only have information about land use rights but the Certificate does not show housing content, they still meet the housing conditions to be considered for buying social housing according to current regulations.
The Ministry of Construction also said that within 7 days from the date of receiving the request for confirmation of housing conditions, the competent authority issuing the Certificate of land use rights and ownership of assets attached to land in the locality where the social housing project is located will carry out the confirmation according to regulations.
In addition to cases where there is no housing, current law also stipulates that cases where there is housing but the average area is less than 15m2/person may also be eligible for housing to buy social housing. The average area is determined based on the number of permanent residents in the house, including the applicant, spouse, parents and children (if any).
According to the Ministry of Construction, to be able to buy social housing, people must simultaneously meet the conditions on subjects, housing and income according to the provisions of the 2023 Housing Law.
This agency recommends that people when applying to register to buy social housing should contact local functional agencies for specific guidance on procedures for confirming housing conditions, to avoid arising problems in the implementation process.
