Clause 3, Article 33 of Decree No. 170/2025/ND-CP (effective from July 1, 2025) stipulates the implementation of the appointment process for personnel from other places:
In case the personnel is expected to be mobilized or appointed by a competent authority from a human resource outside the agency, organization, or unit or proposed by an agency, organization, or unit (from a human resource outside the agency, organization, or unit), the agency or department advising on the organization or staff of the competent authority appointing the person shall carry out the following 3 steps:
Step 1: Exchanging and collecting opinions from the leadership of the agency, organization, or unit where the appointment is expected on the appointment policy.
Step 2: Exchange and collect opinions from the leadership team where the personnel are working on the appointment policy. The collective leadership where the personnel are working organized to collect votes.
The person proposed for appointment must achieve more than 50% of the nomination number (based on the total number of people called up); in case of reaching 50%, the head will consider and decide.
Receive assessments and comments from agencies, organizations, units and personnel records according to regulations.
Meeting with the expected appointed personnel to discuss the requirements of the job.
Step 3: Preside over and coordinate with relevant agencies, organizations and units to appraise personnel and prepare a report to competent authorities for consideration and decision.
In case the personnel meet the prescribed standards and conditions but the agency, organization, unit (where the personnel are working or where they are expected to be appointed) or the personnel expected to be appointed still have different opinions and are not yet unified, the agency, department advising on the organization and staff must fully report the opinions and submit them to the competent authority for consideration and decision.
The head of the agency, organization or unit shall issue a decision on appointment according to his authority or submit it to the competent authority for consideration and decision.
