Binh Phuoc province has proposed specific instructions on preferential allowances, hazardous allowances... for cases of civil servants seconded to state administrative agencies; on achievements to increase salaries ahead of schedule.
Responding to this content, the Ministry of Home Affairs said that regarding preferential allowances for jobs, hazardous allowances... for cases of civil servants seconded to state administrative agencies, it is implemented according to Article 27 of Decree 115/2020/ND-CP dated September 25, 2020 of the Government regulating the recruitment, use and management of civil servants (amended and supplemented in Decree 85/2023/ND-CP dated December 7, 2023 of the Government).
The toxic allowance regime for cadres, civil servants and public employees is implemented in Circular No. 07/2005/TT-BNV dated January 5, 2005 of the Ministry of Home Affairs, calculated based on actual working time in places with toxic and dangerous factors and paid with the monthly salary.
The preferential allowance regime for civil servants is implemented according to legal documents regulating preferential allowances for each sector (health, education, forestry, plant protection, veterinary and dike control, etc.). Therefore, the Ministry of Home Affairs recommends that Binh Phuoc province base on the above regulations for implementation.
Regarding achievements for early salary increase, it is implemented according to the guidance in Circular No. 08/2013/TT-BNV dated July 31, 2013 of the Ministry of Home Affairs guiding the implementation of the regular salary increase regime and early salary increase for cadres, civil servants, public employees and employees (amended and supplemented in Circular No. 03/2021/TT-BNV dated June 29, 2021).
At Point e, Clause 1, Article 3 of Circular No. 08/2013/TT-BNV stipulates: The standards and levels of outstanding achievements in performing tasks and the time for early salary increase corresponding to each different level of achievement of cadres, civil servants, public employees and workers are discussed by the head of the agency or unit managing cadres, civil servants, public employees and workers with the Party Committee and the Executive Committee of the Trade Union at the same level and specified in the Regulation on early salary increase of the agency or unit.
Therefore, the early salary increase for cadres, civil servants, public employees and workers, in addition to the provisions in Clause 1, Article 1 of Circular 08/2013/TT-BNV, also depends on the salary increase regulations of the agency or unit (specifically based on the achievement levels specified in the regulations).
