Mr. Nguyen Thanh Trung (Gia Lai) questioned the policies under Decree 76/2019/ND-CP.
According to Mr. Trung, a number of cadres, teachers and employees previously worked in extremely difficult communes and enjoyed full benefits and policies according to regulations such as: preferential allowances, attraction allowances, first-time allowances and allowances for long-term work in extremely difficult areas.
By 2021, this commune had completed the goal of building new rural areas and was recognized by the Provincial People's Committee as meeting new rural standards.
In Decision No. 861/QD-TTg dated June 4, 2021, this locality was approved as a commune in Area I, so the policies and regimes prescribed in Decree 76/2019/ND-CP are no longer enjoyed and have been paid a one-time subsidy according to Article 8 of Decree 76/2019/ND-CP.
However, by 2022, a number of teachers and commune staff were transferred to work in a commune in region III (a commune that enjoys policies according to Decree 76/2019/ND-CP).
Mr. Trung wondered, will the teachers and staff assigned to work above continue to receive the long-term work allowance in particularly difficult areas of 1.0 as they did before, or will they have to wait until they have worked for 5 years to receive the 5% from the beginning as explained by the superior financial agency?
"Not only that, in one province, some localities continue to enjoy benefits, while others have to recalculate from the beginning. So I respectfully ask the Ministry of Home Affairs to clearly explain this issue," said Mr. Trung.
Regarding the reflection and recommendation of Mr. Nguyen Thanh Trung, the Ministry of Home Affairs has responded on the Electronic Information Portal.
According to the Ministry of Home Affairs, Article 5 of Decree No. 76/2019/ND-CP dated October 8, 2019 of the Government on policies for cadres, civil servants, public employees, workers and salary earners in the armed forces working in areas with particularly difficult socio-economic conditions has specifically stipulated the level of benefits and conditions for receiving long-term work allowances in areas with particularly difficult socio-economic conditions.
Accordingly, the subjects specified in Article 2 of this Decree are entitled to monthly allowances calculated based on the basic salary and actual working time in areas with particularly difficult socio-economic conditions as follows:
1. Level 0.5 applies to people who have actually worked in areas with particularly difficult socio-economic conditions from 5 years to less than 10 years;
2. Level 0.7 applies to people who have actually worked in areas with particularly difficult socio-economic conditions from 10 years to less than 15 years;
3. Level 1.0 applies to people who have actually worked in areas with particularly difficult socio-economic conditions for 15 years or more.
The organization and implementation of policies for cadres, civil servants and public employees in Gia Lai province is under the authority of the Provincial People's Committee.
