Ha Tinh province has requested the Ministry of Home Affairs to urge ministries and branches to issue circulars stipulating standards and conditions for considering promotion of civil servant professional titles to grade II and grade I.
Responding to this content, the Ministry of Home Affairs said that, in performing its assigned tasks, the Ministry of Home Affairs has consulted and submitted to the Government to issue Decree No. 85/2023/ND-CP dated December 7, 2023.
Immediately after issuing Decree No. 85/2023/ND-CP, the Ministry of Home Affairs issued Official Dispatch No. 7415/BNV-CCVC dated December 15, 2023 urging ministries managing professional titles of specialized civil servants to urgently develop and complete regulations on standards and conditions for professional titles of specialized civil servants to have a basis for considering promotion of professional titles of civil servants;
At the same time, urgently develop a Circular to stipulate standards and conditions for promotion to grade II and grade I for administrative officers, clerical officers, and archival officers.
To date, 11/13 ministries managing civil servant professional titles have issued Circulars on considering promotion of civil servant professional titles.
In the coming time, the Ministry of Home Affairs said it will continue to urge ministries to urgently complete the above tasks and synthesize reports to competent authorities according to regulations.
As Lao Dong reported, Long An province also requested the Ministry of Home Affairs to consider and provide guidance on promoting the professional title of civil servants for medical staff.
The Ministry of Home Affairs said that, according to the provisions of the Law on Civil Servants 2010, a professional title is a name that shows the qualifications and professional capacity of civil servants in each professional field (Clause 1, Article 8).
Under the assigned authority, the Ministry of Health has issued Joint Circular No. 10/2015/TTLT-BYT-BNV regulating codes and professional titles of doctors, preventive medicine doctors, and medical assistants.
Accordingly, this Circular clearly stipulates that these are different professional titles, with different responsibilities, tasks, standards, and conditions for each professional title and for each rank in each professional title.
According to the provisions of Clause 3 and Clause 4, Article 2 of Decree No. 115/2020/ND-CP, "Professional title rank" is the level that shows the qualifications, professional competence and skills of civil servants in each professional field; "Professional title promotion" is when a civil servant is appointed to hold a professional title at a higher rank in the same professional field.
Point d, Clause 1, Article 32 of Decree No. 115/2020/ND-CP (amended and supplemented at Clause 16, Article 1 of Decree No. 85/2023/ND-CP) stipulates the criteria and conditions for consideration for promotion.
At the same time, Clause 2, Article 32 stipulates: In the case of civil servants currently ranked in a professional title rank that is no longer regulated by current law, they will be considered for promotion to a higher professional title rank next to the current professional title rank if they are working in a suitable job position and meet the standards and conditions prescribed in Clause 1 of this Article. This provision does not apply to cases where there is a change in the professional title code.
Therefore, the Ministry of Home Affairs proposes to conduct promotion consideration in accordance with the above regulations; only consider promotion to the next higher rank within the same professional title; do not consider promotion combined with consideration of transfer of professional title; when considering transfer of professional title, do not combine with salary increase.
