According to Clause 1, Article 13 of Decree 170/2025/ND-CP (effective from July 1, 2025), part-time workers at the commune level before July 1, 2025 are one of the subjects accepted to work as civil servants.
According to Clause 3, Article 13, based on the rate of civil servants who need to be arranged for each job position in an agency employing civil servants, the assigned staffing quota and the requirements of the job position to be recruited, the head of the competent recruitment agency or the head of the management agency shall consider and accept to work as civil servants in the above cases if they meet the conditions for registration for civil servant recruitment prescribed in Clause 1, Article 19 of the Law on Cadres and Civil Servants 2025, except for cases specified in Clause 3, Article 19 of the Law on Cadres and Civil Servants 2025 or are under disciplinary action, are under the disciplinary action, and are under the implementation of regulations related to discipline according to the provisions of the Party and the law.
In case of non-professional workers at the commune level before July 1, 2025, they must have worked for 5 years or more in accordance with the provisions of law, have paid compulsory social insurance (if not continuous and have not received a one-time social insurance allowance, they will be accumulated, including working time if they have previously held the job position as prescribed above), doing a job with professional and technical requirements in accordance with the job position expected to be received.
