Conditions for receiving back people who were civil servants

A person who was a civil servant is eligible to be accepted as a civil servant if he/she meets the prescribed conditions.

Article 18 of Decree 138/2020/ND-CP is amended by Clause 11, Article 1 of Decree 116/2024/ND-CP effective from September 17. 2024 stipulates the subjects of acceptance as civil servants, specifically as follows:

Accepted as a civil servant

1.Subjects to be received: a) Officials working at public service units; b) Commune-level cadres and civil servants; c) Salary earners in the armed forces, people working in key organizations but not civil servants; d) Chairman of the Board of Members, Chairman of the Board of Directors, Chairman of the Company, Member of the Board of Members, Member of the Board of Directors, Inspector, General Director, Deputy General Director, Director, Deputy Chief Accountant and people holding management positions and titles from department level or higher in enterprises held by the State with over 50% of charter capital, enterprises held by the State or the total number of shares with voting rights; d) People who have been cadres and civil servants who are then authorized to be transferred or rotated to positions are not cadres or civil servants at other agencies and organizations.

Thus, a person who was a cadre or civil servant and was then transferred or rotated by competent authorities to hold positions of non-capecapecy at other agencies and organizations is the subject of being accepted as a civil servant.
