Youme Law Firm LLC said that, based on Article 112 of the 2019 Labor Code, it stipulates:
Holidays, Tet
1. Employees are entitled to take a day off and receive full pay during the following holidays and Tet:
a) New Year's Day: 1 day (January);
b) Lunar New Year: 5 days;
c) Victory Day: 1 day (April 30);
d) International Labor Day: 1 day (May 1);
d) National Day: 2 days (September 2 and 1 day before or after);
e) Hung Vuong's Commemoration Day: 1 day (10th of the third lunar month).
2. Foreign workers working in Vietnam, in addition to the holidays prescribed in Clause 1 of this Article, are also entitled to an additional day off for the traditional New Year and a day off for their country's National Day.
3. Every year, based on actual conditions, the Prime Minister decides specifically on the day off specified in Point b and Point d, Clause 1 of this Article.
Accordingly, the 10th day of the 3rd lunar month is Hung Kings' Commemoration Day, so workers will be given a full salary day on this day.
Pursuant to Article 98 of the 2019 Labor Code, it is stipulated that:
Overtime pay, working at night
1. Overtime workers are paid according to the unit price of salary or actual salary paid for work they are doing as follows:
a) On normal days, at least 150%;
b) On weekly days off, at least 200%;
c) On holidays, Tet, and paid holidays, at least equal to 300%, not including salary for holidays, Tet, and paid holidays for employees receiving daily salary.
2. Employees working at night will be paid an additional 30% of their salary calculated according to the unit price of salary or actual salary paid for work on a normal working day.
3. Employees who work overtime at night, in addition to paying the salary as prescribed in Clauses 1 and 2 of this Article, are also paid an additional 20% of their salary calculated according to the unit price of salary or salary according to work during the day of a normal working day or on a weekly day off or on holidays and Tet.
Based on the above regulations, if including the salary when retiring, employees who go to work on the 10th of March will be paid as follows:
- Work during the day: Receive at least 400% of your normal working day's salary.
- Work at night: Receive at least 4 90% of your normal working day's salary.
Thus, employees who go to work on the 10th of March will receive a salary higher than the normal day.
