According to Clause 2, Article 7 of Decree 178/2024/ND-CP (amended and supplemented in Decree 67/2025/ND-CP), cadres and civil servants in the organizational reorganization, if meeting the conditions of age and time of compulsory social insurance payment, will be retired early without deduction of pension ratio. Specifically:
Cases of age with 2 to less than 10 years compared to the retirement age specified in Appendix I and II of Decree 135/2020/ND-CP and eligible for the time of social insurance payment, will be entitled to the following benefits:
- Enjoy pension according to the level of social insurance law without deducting ratio due to retirement before age.
- Apply a number of preferential regimes if there are 15 years of hard work, toxic, dangerous or working in areas with extremely difficult socio -economic conditions.
According to the 2014 Social Insurance Law and the Law on Social Insurance 2024 (effective from 1.7.2025), the monthly pension remains the following calculation:
- For female workers equal to 45%of the average salary as a basis for paying social insurance, equivalent to 15 years of social insurance premiums, then adding each year to pay an additional 2%, the maximum level is 75%;
- For male workers equal to 45%of the average salary as a basis for paying social insurance, equivalent to 20 years of social insurance payment, then adding each year to pay an additional 2%, the maximum level is equal to 75%.
In case the male labor has the time to pay social insurance from full 15 years to less than 20 years, the monthly pension is equal to 40% of the average salary as a basis for paying social insurance for 15 years of paying social insurance, and then adding 1% more each year.
Thus, cadres, civil servants, officials and employees retired before the age due to the arrangement of the apparatus, they still enjoy the maximum pension of 75% of the average salary as a basis for paying social insurance.
In order to enjoy the maximum pension, female workers must have time to pay compulsory social insurance for 30 years, male workers have time to pay compulsory social insurance for 35 years.
