According to the regulations issued by the Ho Chi Minh City People's Committee, the Chairman of the People's Committee of the commune, ward, and special zone of Con Dao presides over the direction of establishing a working group to initially resolve collective labor disputes and strikes that are not in accordance with labor law in enterprises located in the management area.
The working group will take steps to resolve strikes that are not in accordance with labor law as follows:
Within 12 hours from the date of receiving information about signs or risks of a strike not complying with labor law, the Chairman of the People's Committee of the commune, ward, and special zone of Con Dao presided over the direction of the working group to directly meet with employers and representatives of the management board to organize labor representation to listen to opinions to support the parties in finding solutions to bring production and business activities back to normal.
The working group determined the causes of labor disputes, the wishes of the collective of employees, the opinions of employers and recommended solutions to resolve labor disputes in accordance with labor law regulations and the actual situation at enterprises
The working group will guide and explain how to encourage employees and employers to negotiate and agree on a solution based on goodwill to respect the rights and interests of each party.
In case the parties successfully mediate or approve the mediation and settlement plan for labor disputes, the working group shall guide the parties to make a record of the agreement between the parties responsible for implementing the agreements stated in the record.
In case the parties do not reach an agreement or the negotiation does not achieve results, the Working Group will guide the parties to resolve labor disputes in accordance with the procedures prescribed by labor law.
For cases of labor disputes at places where strikes are not allowed, instructions should be explained to employees and employers to resolve labor disputes in accordance with the procedures prescribed by labor law.
