The Lao Dong Newspaper's legal consulting office said that employees who are participating in compulsory social insurance (SI) will enjoy many benefits related to maternity benefits and subsidies, especially if they adopt a child under 6 months old.
Maternity leave until the child is 6 months old
According to Clause 1, Article 56 of the Social Insurance Law 2024, employees who adopt children under 6 months old are entitled to maternity leave from the date of delivery until the child is 6 months old.
In cases where both father and mother participate in compulsory social insurance and are eligible for maternity benefits, the law stipulates that only one of them, the father or mother, is entitled to receive this benefits.
If the employee does not quit, they will still receive a one-time allowance according to the provisions of Article 58 of the law.
Receive a one-time allowance when adopting a child
Article 58 of the 2024 Social Insurance Law stipulates that employees who adopt children under 6 months old and meet the conditions under Clause 2, Article 50 of the Law will receive a one-time allowance.
The one-time allowance is calculated at 2 times the reference level for the month in which the female employee gives birth or adopts a child.
Receive maternity allowance
In addition to the above benefits, according to Article 59 of the Social Insurance Law 2024, employees who adopt children are also entitled to a monthly maternity allowance equal to 100% of the average salary used as the basis for compulsory social insurance contributions for the last 6 months before leaving work.
Thus, employees who adopt children, especially children under 6 months old, are not only entitled to maternity leave but can also receive important allowances, contributing to ensuring rights and income while taking care of their young children.
