Article 19 of Decree No. 170/2025/ND-CP (effective from July 1, 2025) stipulates the recruitment, use and management of civil servants as follows:
1. No later than 5 working days from the deadline for completing the recruitment documents as prescribed in Clause 1, Article 18 of this Decree, the head of the competent recruitment agency shall make a recruitment decision and send a notice to the successful candidate. The content of the recruitment decision includes recruitment, job placement and ranking corresponding to the recruitment job position. The competent recruitment agency is responsible for requiring the competent authority according to the provisions of law on criminal records to issue a criminal record of the successful candidate.
2. No later than 30 days from the date of the recruitment decision, the recruited person must come to receive the job, unless the recruitment decision stipulates another deadline or the competent recruitment agency agrees to extend it.
3. In case the employee does not come to work within the time limit prescribed in Clause 2 of this Article or the Judicial Record Certificate is determined to be one of the cases where he/she cannot register to be recruited as a civil servant, the head of the competent recruitment agency shall cancel the recruitment decision.
4. After the deadline specified in Clause 2 of this Article, the competent authority shall publicly announce on the agency's website or electronic information portal and send a notice to the candidates whose recruitment results are lower than the recruitment results of the successful candidate whose recruitment results are canceled according to the provisions of Clause 2, Article 18 of this Decree or the recruitment decision shall be canceled according to the provisions of Clause 3 of this Article to complete the application and issue a recruitment decision no later than 15 days from the date of expiration of the term specified in Clause 2 of this Article.
In case there are 2 or more people with lower recruitment results than the same, the head of the competent recruitment agency shall decide on the successful candidate according to the provisions of Clause 2, Article 10 of this Decree (in case of organizing the recruitment exam) or the provisions of Clause 2, Article 12 of this Decree (in case of organizing the recruitment exam).
