This morning (September 3), in Hanoi, the Office of the President held a press conference to announce the President's Order promulgating the Laws and Orders that were just passed by the 15th National Assembly at the 9th Session, including the Law on Civil Servants 2025.
At the press conference, Mr. Truong Hai Long - Deputy Minister of Home Affairs - informed about the new points of the Law on Cadres and Civil Servants in 2025. Accordingly, the Law consists of 7 Chapters and 45 Articles with new contents as follows:
connect commune-level cadres and civil servants with provincial levels, unify a civil service regime from the central to commune levels to implement the policy of building a unified, connected, and synchronous civil service from the central to commune levels, without distinguishing between commune-level cadres and civil servants and provincial levels.
Regulates the transition of commune-level cadres and civil servants according to the provisions of the current Law to cadres and civil servants according to the new provisions of the Law on Cadres and Civil Servants if they meet the standards and conditions on training qualifications without the requirements on working time, standards and conditions of civil servant ranks.
Transform the method of managing cadres and civil servants according to job positions, taking job positions as the center, based on the requirements of job positions and the results, products and tasks to recruit, arrange, use, evaluate, train, plan, and appoint cadres and civil servants.
Complete the concept of job positions; classify civil servant job positions into 3 groups including: Leadership and management job positions; Professional and technical job positions; And support and service job positions. Remove the regulation on promotion exams, instead, the mechanism for arranging to any job position is to be classified in the corresponding civil servant rank.
Regulate the transition period for completing the arrangement to job positions and corresponding rankings for civil servants who were recruited before the effective date of this law.
According to Mr. Truong Hai Long, one of the new points of the law is to improve the effectiveness of evaluating, using and screening cadres and civil servants.
Accordingly, the law stipulates the principles, authority, content, and methods for evaluating and classifying the quality of civil servants based on regular, continuous, multidimensional monitoring and qualitative assessment using specific criteria associated with progress, quantity, and quality of results and products according to job position (KPI); using assessment results to implement rewards, additional income regimes, bonuses, or considering placement in lower job positions or laying off work to screen for people who do not meet the requirements of the tasks and leave the apparatus; at the same time, specifically stipulate the responsibility of the head in managing, evaluating and using civil servants with the right capacity and job position.
The 2025 Law on Cadres and Civil Servants also completes regulations on disciplinary action against cadres and civil servants. The law has eliminated the form of disciplinary dismissal for civil servants in leadership and management positions; not continuing to stipulate salary reduction as a form of disciplinary action, ensuring consistency and unity between Party discipline regulations and administrative discipline, synchronously using civil servant assessment results according to new regulations of the law.
