Article 15 of Decree 374/2025/ND-CP stipulates as follows:
Level and month of unemployment benefits
1. The monthly unemployment benefit level of employees is determined as follows:
Monthly unemployment benefit level = Average salary of 6 consecutive months with unemployment insurance contributions before unemployment x 60%
In case in the last months before unemployment, the employee has a period of interruption of unemployment insurance contribution, the next 6 months to calculate the level of unemployment benefits are the average salary of 6 months of unemployment insurance contribution before the employee terminates the labor contract, working contract or terminates work according to the provisions of law.
The monthly unemployment benefit level of employees is no more than 5 times the regional minimum wage that has been paid for unemployment insurance according to the provisions of the Labor Code at the time of termination of the labor contract.
2. Months of unemployment benefits are calculated according to the Gregorian calendar. Each month of unemployment benefits is calculated from the date the employee starts receiving unemployment benefits to that day of the following month minus 1 day, in case the following month does not have a corresponding day, the end date of the month of unemployment benefits is the last day of that month.
Thus, the month of receiving unemployment benefits is calculated according to the calendar month. Each month of receiving unemployment benefits is calculated from the date the employee starts receiving unemployment benefits to that day of the following month minus 1 day, in case the following month does not have a corresponding day, the end date of the month of receiving unemployment benefits is the last day of that month.
