Clause 1, Article 19 of Decree 374/2025/ND-CP stipulates 13 cases where employees who are receiving unemployment benefits are terminated from receiving unemployment benefits, including:
(1) Having a job and being subject to compulsory social insurance according to the provisions of the 2024 Social Insurance Law
(2) Performing military service, duty to participate in the People's Police, standing militia
The date on which the worker is determined to perform military service, the obligation to participate in the People's Police, and the standing militia is the date the worker enlists.
(3) Monthly pension
The date on which the employee is determined to receive a pension is the first day of calculating pension benefits recorded in the social insurance agency's document on the monthly pension benefit of the employee.
(4) After 2 times the employee refused the job introduced by the public employment service organization where they are receiving unemployment benefits without a valid reason
(5) During the period of receiving unemployment benefits, for 3 consecutive months, not to issue monthly notices about job search to public employment service organizations as prescribed.
(6) Go abroad to settle down
The date on which the worker is determined to settle abroad is the date the worker leaves the country according to the provisions of law on entry and exit.
(7) Studying for a term of over 12 months
The date on which the employee is determined to go to study for a term of more than 12 months is the enrollment date recorded in the admission notice.
(8) Being administratively sanctioned for violating the law on unemployment insurance
The date on which the employee is determined to be administratively sanctioned as mentioned above is the date the employee is sanctioned according to the decision of the competent authority.
(9) Death
The date of determination of the worker's death is the date recorded in the death certificate.
(10) Compliance with the decision to apply measures to send them to reform schools, compulsory education institutions, and compulsory drug rehabilitation centers
The date on which the employee is determined to comply with the decision to apply the measure of sending him to a reformatory, compulsory education institution, or compulsory drug rehabilitation center is the date of commencement of the administrative handling measure recorded in the decision of the competent authority.
(11) Declared missing by the court
The date of the worker's disappearance is determined in the court's decision.
(12) Being detained, serving a prison sentence
The date on which the worker is determined to be in temporary detention and serving a prison sentence is the date of commencement of the decision to temporarily detain and serve a prison sentence of the competent authority.
(13) According to the employee's request
The day the employee is terminated from receiving unemployment benefits is the day the employee requests the public employment service organization.
