The current Law on Employment stipulates the subjects required to participate in unemployment insurance in Article 43.
Accordingly, employees must participate in unemployment insurance when working under a labor contract or a labor contract in 3 cases.
- Unlimited contract.
- fixed-term contract.
- seasonal or work contract with a term of 3 months to less than 12 months.
The 2025 Law on Employment, effective from January 1, 2026, stipulates the subjects participating in unemployment insurance in Article 31, expanding the number of groups of workers participating:
- Employees working under indefinite-term labor contracts, fixed-term labor contracts of 1 month or more, including cases where employees and employers agree with other names but have content showing that the employment is paid, salary and management, operation and supervision by one party.
- Employees who work part-time, have a monthly salary equal to or higher than the lowest salary used as the basis for compulsory social insurance contributions.
- People working under labor contracts.
- Enterprise managers, controllers, capital representatives of enterprises as prescribed by law; members of the Board of Directors, general directors, directors, members of the Control Board or controllers and other management positions elected by cooperatives and cooperative unions as prescribed by the Law on Cooperatives with salary.
