On the morning of November 9, the National Assembly heard a report examining the draft Law on Employment (amended).
Regarding the expansion of unemployment insurance (UI), Chairwoman of the Social Committee Nguyen Thuy Anh said that expanding the scope of unemployment insurance (UI) as proposed in the draft law to meet and achieve the target set out in Resolution No. 28-NQ/TW (by 2030, about 45% of the workforce will participate in UI) is very challenging.
The Social Committee recommends that the drafting agency continue to forecast the number of expansions, supplement impact assessments, and have solutions presented in the draft law to ensure the feasibility of the regulations.
Ensure compatibility between the subjects participating in unemployment insurance and the subjects participating in compulsory social insurance (SI) because the collection and management of these subjects are all performed by the SI agency.
The Standing Committee of the Law Committee proposed clarifying regulations on participation in unemployment insurance for subjects who do not receive salary for 14 working days or more in a month.
According to the Social Committee, regulations on flexible unemployment insurance contribution levels for employees and employers may cause inconsistent contribution levels, affect beneficiary regimes and reduce revenue for the Unemployment Insurance Fund.
This content has not been carefully evaluated and forecasted. The Social Committee recommends that the Government carefully consider this issue and seek opinions from relevant ministries, branches, and affected subjects.
Assess the impact seriously, have a clear basis for appropriate regulations to ensure the rights of employers and employees, and preserve the Unemployment Insurance Fund.
There are opinions in the Social Committee suggesting that the unemployment insurance contribution rate should be kept as currently regulated when there is no method or forecast for unemployment for each industry and each group of subjects each year, but instead focus on adding support policies for employers with the current fund source, which can determine support policies for each industry, each profession, and each time period.
The Social Committee highly appreciates the Government's proposal to regulate the mechanism for handling cases of late payment or evasion of social insurance payment so that employees can enjoy social insurance benefits.
However, it is recommended that the Government clarify the mechanism to separate the amount of late payment and evasion of social insurance from the total amount of late payment and evasion of social insurance, unemployment insurance, and health insurance.
Research and supplement regulations on closing the period of participation in unemployment insurance with the period of participation in social insurance and health insurance in cases where employees pay unemployment insurance but have not paid social insurance to ensure consistency, feasibility and uniformity.
The Social Committee recommends that the Government study and regulate forms of investment to increase the Unemployment Insurance Fund in accordance with the nature of the Unemployment Insurance Fund and the management and investment methods of the Social Insurance Fund of Vietnam Social Security.
Regarding the expenses for organizing and operating unemployment insurance, the Social Committee finds that the provisions in the draft law are unclear about the reasonableness of allocating funds for expenses for organizing and operating unemployment insurance because the implementation of unemployment insurance policies is jointly carried out by the employment service center and the social insurance agency; the reasonableness and proportionality with the spending tasks from the Social Insurance Fund.
The Social Committee requested the Government to clarify the basis for not proposing amendments to regulations on sources of expenditure for organizing and operating social insurance.
There is a proposal to regulate the allocation of organization and operation of the Unemployment Insurance Fund similar to the Social Insurance Fund because of similarities.
