From January 1, 2026, the 2025 Teachers Law officially takes effect, clearly stipulating the retirement regime for teachers according to the roadmap of the Labor Code and related documents.
Legal basis on retirement age Article 26 of the 2025 Teachers Law clearly states: The retirement age of teachers is implemented according to the Labor Code and other provisions of law, except for some special cases. Notably, preschool teachers who wish can retire 5 years earlier, up to the retirement age under normal conditions. If they have paid social insurance for 15 years or more, the pension percentage will not be reduced when retiring early.
Along with that, Decree 135/2020/ND-CP stipulates the roadmap for increasing the retirement age of employees under normal conditions: Increase by 3 months each year for men until they reach 62 years old in 2028, and increase by 4 months each year for women until they reach 60 years old in 2035.
According to this roadmap, in 2026, the retirement age under normal working conditions is determined as follows:
For male teachers in normal working conditions, the retirement age in 2026 will be 61 years and 6 months.
For female teachers in normal working conditions, the retirement age in 2026 will be 57 years old.
In addition, according to Clause 2, Article 26 of the 2025 Law on Teachers, teachers in preschools, if they wish, can retire at a lower age than the retirement age of employees under normal conditions but not more than 05 years old.
In addition, teachers who are teachers are also eligible for early retirement in some cases in Clause 2, Article 27 of the 2025 Law on Teachers as follows:
- Not more than 05 years old for teachers with a doctorate degree;
- Not more than 07 years old for teachers with the title of associate professor;
- Not more than 10 years old for teachers with the title of professor.
