The Law on Teachers has been passed by the National Assembly and officially took effect from January 1, 2026. The law clearly stipulates the rights and obligations of teachers as well as prohibited acts, including many points related to extra teaching and learning activities.
According to Article 11, the Law strictly prohibits teachers from forcing students to participate in extra classes, paying money or gifts outside of regulations, and at the same time, not taking advantage of the name of a teacher for personal gain. Thus, the Law does not absolutely prohibit additional teaching, but requires voluntariness, transparency and no pressure on learners.
Previously, the Ministry of Education and Training issued Circular 29/2024/TT-BGDDT, effective from February 14, 2025, specifically regulating the principles of organizing extra teaching and learning.
Accordingly, this activity is only carried out when students have a need, have the consent of parents and cannot cut the main content of the course. The time and form of tutoring must be appropriate for the age, ensure safety and not affect the health of students.
In schools, tutoring is only applied to students who do not meet the requirements, excellent students are selected for training or final year students who need review. This activity is completely free, no fee is collected, no more than 2 periods/subject/week and the number of students per class is not more than 45 students. Teaching content must not be pre-current and must be transparent.
In addition to schools, tutoring institutions must register for business and publicize information about subjects, times, locations, lists of teachers and fees before organizing. Teachers participating in extra teaching must have appropriate moral qualities and professional qualifications. In case a teacher is teaching at a school, he/she must report to the Principal about the content, time and location of additional teaching.

According to current regulations, the management of extra teaching and learning activities will be decentralized to the People's Committees at the commune level, including guidance, inspection, handling of violations and safety supervision, and extra study hours.
With the above regulations, the Ministry of Education and Training affirms the viewpoint of not absolutely banning extra teaching activities, aiming to ensure fairness in educational access, reduce pressure on students and improve the quality of main curriculum teaching.
