The Ministry of Education and Training (MOET) has just announced a draft Circular regulating the authority to recruit teachers to collect public comments.
According to the draft, the Department of Education and Training will preside over the recruitment organization for kindergartens, primary schools, secondary schools, and general schools with many levels of education, with the highest level being junior high school. In case the Chairman of the Provincial People's Committee decides on recruitment to another agency or unit, the decentralization must be advised and implemented by the Department of Education and Training. If decentralizing to the educational institution itself, this unit must meet the prescribed conditions.
Similarly, with high schools, general schools with many levels of education (the highest level is high school), specialized schools and continuing education institutions, the Department of Education and Training is still the recruitment lead unit. However, principals or facility directors can directly recruit if the Provincial People's Committee decentralizes and the facility meets the prescribed conditions.
Particularly for university transfer schools or schools under state agencies and political organizations, heads of educational institutions are eligible for recruitment under their management.
Educational institutions that need to be decentralized for recruitment must submit documents to the Department of Education and Training for appraisal, including submissions, evidence of conditions and draft recruitment plans. Within 5 working days, the Department of Education and Training must appraise and submit to the Chairman of the Provincial People's Committee for consideration and decision.
Based on the appraisal results and actual needs, the Chairman of the Provincial People's Committee will decide to decentralize or not decentralize the recruitment rights to educational institutions.
These are new points in teacher recruitment. Previously, the recruitment of teachers under the authority of the Home Affairs sector and the People's Committees at the district/provincial level, the education sector only had the function of advising. This leads to certain shortcomings in the management and development of the teaching staff.
The Circular is expected to take effect from January 1, 2026.
