Ms. Nguyen Thi Thu (TPHC) is a primary school teacher, a civil servant's secondary school teacher and entered the industry on August 1, 2015, currently holding the professional title of Grade II primary school teacher (V.07.03.07).
Recently, Ms. Thu's school announced that due to the removal of the district-level management unit, the school proposed to transfer Ms. Thu to a grade III primary school teacher (V.07.03.29) because her professional title code (V.07.03.07) was not included in the job position plan.

Ms. Thu said that, referring to Circular No. 08/2023/TT-BGDDT, she found that when she has enough time to hold the 9th grade (excluding internship), that is, on August 1, 2025, she will be transferred to a grade II primary school teacher (V07.03.28).
Ms. Thu asked, is it in accordance with regulations that the school requires her to change to the professional title of Grade III primary school teacher (V.07.03.29?
The Ministry of Education and Training responds to this issue as follows:
Clause 12, Article 5 of Circular No. 08/2023/TT-BGDDT stipulates: "From November 3, 2015 to the effective date of this Circular, in case preschool and primary school teachers are appointed to a higher rank after the end of their probationary period or after achieving a training level higher than the prescribed level but not meeting other standards as well as not being admitted in exams or being considered for promotion organized by competent authorities, they must be reappointed to the correct rank according to regulations (including cases of recruitment before November 3, 2015 and completing the probationary period according to regulations after November 3, 2015)".
If Ms. Nguyen Thi Thu is appointed to the professional title of Grade II primary school teacher (code V.07.03.07) after November 3, 2015 without passing the exam or being considered for promotion organized by the competent authority, she is eligible to be reappointed to the professional title of Grade III primary school teacher (code V.07.03.29) according to the above regulations.
If she is not in the case specified in Clause 12, Article 5 of Circular No. 08/2023/TT-BGDDT, according to the provisions of Point c, Clause 1, Article 7, Circular No. 02/2021/TT-BGDDT amended and supplemented in Clause 7, Article 2 of Circular No. 08/2023/TT-BGDDT, she will be appointed to the professional title of Grade II Primary School Teacher (code V.07.03.28) if she has a total period of holding the professional title of Grade III Primary School Teacher (code V.07.03.08) and Grade II (code V.07.03.07) or equivalent of 9 years or more (excluding probationary period).
The Ministry of Education and Training also requested Ms. Thu to provide complete supporting documents to the competent authority appointing the professional title in the locality for specific instructions.
