Mr. Nguyen Viet Khoa was born in 1970, former Vice Principal of a primary and secondary school in Bac Ninh province (old).
Mr. Khoa worked for a time at the District Department of Education and Training (September 1999-12.2006) in the form of a meeting.
During the review period, Mr. Khoa worked at the Department of Education and Training and still returned to the school to fulfill his teaching duties according to the regulation of 4 periods/week.
When implementing Decree No. 54/2011/ND-CP dated July 4, 2011 of the Government on seniority allowances for teachers, the district's authorities verified that he was qualified and the Chairman of the District People's Committee decided to give him seniority allowances according to Decision No. 1330/QD-UBND dated December 26, 2012.
Mr. Khoa retired early according to Decree No. 178/2024/ND-CP, receiving social insurance benefits from April 1, 2025 according to the decision of the Chairman of the District People's Committee but has not yet received pension benefits.
According to the answer of the Social Insurance agency, during the period of transfer and secondment to the Department of Education and Training, Mr. Khoa did not directly teach, so it was not counted as the time to receive seniority allowances for teachers.
On July 1, 2025, the inter-district Social Insurance also directly went to the school to verify that during the probationary period, he still returned to the school to teach according to his obligations, which was correct. During his probationary period working at the Department of Education and Training, he was not a specialist, was not paid according to the specialist rank, was not entitled to public service allowances, and was still paid according to the teacher rank.
During this time, he was also allowed by the district to pay social insurance at the Department of Education and Training. Mr. Khoa asked, during the probationary period working at the Department of Education and Training, will you be entitled to seniority allowances for teachers?

The seniority allowance regime for teachers is implemented according to Decree No. 77/2021/ND-CP dated August 1, 2021 of the Government, the subjects of application are teachers who are teaching and educating in public educational institutions.
In case of being allowed to practice at the Department of Education and Training but still fully performing the number of teaching hours prescribed at the school, they are still eligible for seniority allowances for teachers.
