In September 2016, Mr. Le Dong Hoi was recruited by the Department of Home Affairs as a primary school teacher, on probation for 6 months. On March 1, 2017, he was appointed to the professional title of Grade IV Primary School Teacher (code V.07.03.09).
In October 2022, he was ranked as a Grade III Primary School Teacher (code V.07.03.29). In 2021, he graduated with a master's degree in Education Management. Up to now, he has held the old IV rankings and the new III rankings for 8 years.
Mr. Hoi said that according to Circular No. 08/2023/TT-BGDDT of the Minister of Education and Training, teachers with a master's degree will have their conditions for holding a III license reduced to 6 years. However, Circular No. 13/2024/TT-BGDDT dated October 30, 2024 of the Minister of Education and Training did not mention reducing the number of years of holding the rank for teachers with a master's degree. Mr. Hoi asked, in your case, are you eligible for promotion to Grade II?
The Ministry of Education and Training responds to this issue as follows:
Clause 3, Article 10 of Circular No. 02/2021/TT-BGDDT has been amended and supplemented in Clause 9, Article 2 of Circular No. 08/2023/TT-BGDDT stipulates:
"In case a teacher takes the exam or is considered for promotion to the professional title of Primary School Teacher grade II (code V.07.03.28) if he/she has a master's degree or higher and meets the training standards of a Grade II Primary School Teacher and has held the professional title of Grade III Primary School Teacher grade III (code V.07.03.29) or equivalent for 06 (six) years or more (excluding probationary period) up to the deadline for submitting the application for registration or considering promotion, it is determined to meet the requirements for the time holding the rank according to the provisions of Point i, Clause 4, Article 4 of this Circular".
If Mr. Hoi has met the training standards of a Grade II Primary School Teacher (code V.07.03.28), has a Master's degree in Education Management, has held the professional title of Grade III Primary School Teacher (code V.07.03.29) for 8 years and is equivalent to 8 years (as provided by him), then he has met the requirements for the retention period to register for promotion from a Grade III Primary School Teacher to Grade II when the locality organizes the promotion.
