This Circular stipulates the authority to recruit teachers in public educational institutions under the national education system; applies to public educational institutions, Departments of Education and Training, organizations, and other related individuals; does not apply to educational institutions specified in points a, b, c, clause 2, Article 14 of the Law on Teachers No. 73/2025/QH15.
Authority to recruit teachers in preschool, general education, and continuing education institutions
According to the Circular, the authority to recruit teachers in preschool education institutions, general education, continuing education, specialized schools (except for university preparatory schools) and public vocational secondary schools shall be implemented according to the provisions of point a, clause 1, Article 2 of Resolution No. 248/2025/QH15 of the National Assembly on a number of specific and outstanding mechanisms and policies to implement breakthroughs in education and training development.
Point a, Clause 1, Article 2 of Resolution No. 248/2025/QH15 stipulates: The Director of the Department of Education and Training has the authority to recruit and receive teachers, managers of educational institutions and staff in preschool education, general education, continuing education, specialized schools and public vocational secondary schools (public educational institutions) in the province; exercise the authority to transfer, transfer, assign, appoint, change job positions for teachers, managers of educational institutions and staff in public educational institutions under their management authority and for public educational institutions related to a scope of 02 or more commune-level administrative units in the province.
Authority to recruit teachers in other educational institutions under the national education system
The Circular stipulates that the principals of preparatory universities, Friendship School T78, Friendship School 80, and Viet Bac Highland High School have the authority to recruit teachers under their management authority.
Heads of schools of state agencies and political organizations; political schools of provinces and cities directly under the Central Government; political centers of communes, wards, and special zones directly under provinces and cities directly under the Central Government have the authority to recruit teachers under their management authority.
The Director of the Department of Education and Training has the authority to recruit teachers in other educational institutions (except for educational institutions specified in Article 3 of this Circular) under the management authority of provinces and centrally-run cities.
The Circular takes effect from January 20, 2026.
