The Ministry of Education and Training is seeking public opinion on the draft Decree detailing a number of articles of the Law on Vocational Education.
A notable content is the proposal for a heavy, toxic, and dangerous allowance regime for teachers teaching in public vocational training institutions.
According to Article 22 of the draft Decree, the beneficiaries of the allowance are teachers who teach practical or both theory and practice in practice rooms, practice workshops of public vocational training institutions or at enterprises, production - business - service establishments, in industries and occupations with heavy, toxic and dangerous factors.
The draft clearly lists 4 groups of factors as the basis for receiving allowances, including:
Direct exposure to toxins, toxic gases, and dust; teaching in an environment prone to infection and at risk of infectious diseases according to regulations;
Working in an environment with high pressure or lack of nutrients, places that are too hot or too cold beyond the permitted standards;
Teaching majors and occupations that generate loud noises and vibrations continuously with high frequency exceeding labor safety standards;
Environment with radiation, radiation or electromagnetic fields exceeding the permitted level.
As long as there is one or more factor, a practical teacher is eligible to be considered for allowances at the corresponding level.
Proposed allowance level according to the number of harmful factors
The draft Decree proposes 4 allowance levels, calculated according to the coefficient compared to the basic salary:
Level 0.1: There is 1 factor of hardship, toxicity, danger;
Level 0.2: There are 2 factors;
Level 0.3: There are 3 factors;
Level 0.4: There are 4 factors: hardship, toxicity, danger.
This decentralization aims to ensure fairness, accurately reflecting the level of risk in the working environment of each industry and profession.
How to calculate and pay allowances
The allowance for heavy, toxic, and dangerous allowances is calculated based on the actual number of practical teaching hours of teachers for sectors and occupations with dangerous factors.
In which: The standard for teaching hours in a month is determined by the standard for teaching hours in a year divided by 12 months; Allowances are paid with the same monthly salary. And the allowance is not used to calculate social insurance contributions and benefits.
Responsibility for determining the benefit level
The head of a vocational education institution is responsible for specifically determining the allowance level for each teacher, based on the number of heavy, toxic, and dangerous factors in teaching practice.
In addition, the draft also allows vocational training institutions, schools under state agencies, and socio-political organizations to stipulate additional allowances suitable to practical conditions, but not lower than the minimum level stated in the Decree.
The draft is currently being consulted, if approved, it will contribute to compensating for specific working conditions, ensuring legitimate rights for vocational teachers in a risky environment.
