The Ministry of Education and Training (MOET) is seeking opinions on the draft Decree detailing a number of articles of the Law on Vocational Education, notably proposing an allowance regime for teachers in public vocational training institutions.
This is a content that many teachers are interested in, especially the integrated teaching team, practical teaching and teaching students with disabilities.
According to the Ministry of Education and Training, the draft Decree is built on the basis of inheriting, amending and perfecting current regulations in Decree No. 113/2015/ND-CP, to ensure no legal gaps, while continuing to maintain specific policies that have been and are being applied to vocational teachers.
40% allowance for teachers teaching integrated and practical teaching
According to the draft, physical education teachers in public vocational training institutions are still entitled to general policies for teachers as prescribed in Clause 1, Article 24 of the Law on Vocational Education. At the same time, this group is subject to the allowance regime according to Chapter IV of the draft Decree, depending on the subject, teaching form and nature of the work.
Notably, the draft continues to affirm specific allowances for the vocational education system, different from the vocational preferential allowances applied generally to civil servants and employees in public educational institutions.
According to the draft, integrated teachers, teachers who are excellent artisans or higher, or people with a national vocational skills certificate of level 4 or higher, level 5/6, 6/7 or equivalent, directly teaching and practicing at colleges and secondary schools will receive a preferential allowance of 40%.
This regulation aims to accurately recognize the characteristics of professional labor, high practical skills and responsibility for passing on the profession of the vocational education teachers - a force that plays a key role in training technical human resources.
Teaching students with disabilities: Allowances can be up to 85%
One content that is considered humane and highly encouraged is the allowance regime for teachers teaching students, students with disabilities, with the allowance level based on the proportion of learners in the class and the teaching environment.
Teachers in classes with less than 50% of students and students who are disabled (not special classes or schools) are entitled to a 50% discount. If the class has 50% or more students with disabilities, the allowance will increase to 65%.
In particular, teachers teaching at schools, classes, centers dedicated to people with disabilities or integrated education development centers will receive the highest preferential allowance - 85%, along with a job responsibility allowance equal to 0.2 times the basic salary.
How to calculate and principles of allowances
According to the draft, the method of calculating occupational allowances, the time not included in the allowance, the payment method and funding source will be implemented according to current law. At the same time, the draft also clearly states the principle of not having overlapping policies.
Teachers who have received preferential allowances under this Decree will not continue to receive preferential allowances according to the general regulations of the Government for civil servants and employees.
However, in cases where teachers have less hours or hours of teaching for students and students with disabilities than the number of hours teaching classes without students with disabilities, teachers will be subject to preferential allowances according to general regulations for civil servants in public educational institutions.
What should teachers pay attention to?
The draft Decree shows the orientation to continue to care for and ensure the rights of vocational education teachers, especially those working in special, high-pressure environments.
Teachers need to closely monitor the process of completing the Decree, compare personal conditions to clearly understand the allowances they can receive, and proactively reflect and give comments to make the policy more practical when issued.
