The draft Decree details a number of articles of the Law on Teachers that the Ministry of Education and Training is seeking opinions on, including the following concepts:
Teacher professional advancement is the act of a teacher being appointed to a position associated with a higher title in the same level of education or training program, demonstrating the professional development of teachers.
Sequential promotion: Teachers who meet the professional standards of the professional title are higher than the adjacent in the same level of education, training level are considered for professional promotion according to regulations.
Promotion is the case of a teacher being considered for appointment to a higher professional title than the next or highest in the same level of education and training. Promote the application of the method to teachers with outstanding achievements in professional activities or being recognized and appointed to the title of Professor and Associate Professor.
Bases and principles for considering teacher promotion

The basis for considering teacher promotion is as follows:
The consideration of professional promotion for teachers must be based on the job position and professional standards for teachers. For public educational institutions, the consideration of promotion of the teaching profession must comply with the structure according to the professional title approved by competent authorities, except for cases of promotion as prescribed in Article 14 of this Decree.
Teachers are allowed to register for professional promotion if the educational institution has a need and the teacher meets the professional standards of teachers according to the provisions of law.
In principle, the teacher's professional promotion exam is organized according to the principles of equality, publicity, transparency, objectivity and compliance with the law.
Standards and conditions for registration for consideration for teacher promotion
Teachers are eligible to register for professional promotion when meeting the following standards and conditions:
Be classified as having completed the task well or better in the year of work immediately preceding the year of professional promotion;
Have good political qualities and professional ethics;
Not within the disciplinary action period; not within the implementation period of regulations related to discipline as prescribed by the Party and the law;
Meet the professional standards for the title of teacher to be considered for professional promotion, except in cases of special promotion consideration.
Authority and organization of consideration for teacher promotion
The draft Decree stipulates that the Chairman of the People's Committee at the commune level shall exercise the authority to consider professional promotion for teachers in public educational institutions under his/her management authority;
The Director of the Department of Education and Training shall exercise the authority to consider professional promotion for teachers in public educational institutions under the management authority and for educational institutions related to the scope of 2 or more commune-level administrative units;
For public vocational training institutions, public universities, and vocational schools, the consideration of teacher promotion is carried out by the head of the educational institution and is responsible for his/her decision;
For non-public educational institutions, the consideration of promotion of the teaching profession is carried out by the head of the educational institution according to the regulations on organization and operation of the educational institution;
For educational institutions under the armed forces, the consideration of promotion of the teaching profession is regulated by the Minister of National Defense and the Minister of Public Security;
For schools of state agencies, political organizations, socio-political organizations implementing training and fostering programs and other programs, considering the promotion of the teaching profession by the competent authority managing the educational institution;
For educational institutions not specified in Clauses 1,2,3,4,5,6 the consideration of teacher promotion shall be decided by the competent authority managing the educational institution.
