Ms. Le Thao (Vinh Phuc) has been on the payroll and has been teaching at a high school for 15 years as a grade III high school teacher (V.07.05.15). From October 2009 to present, Ms. Thao has been teaching at a middle school, with a current salary of level 5 and a salary coefficient of 3.66.
Mrs. Thao asked: "According to the regulations, what rank will I be in middle school?"
The Ministry of Education and Training responded to this issue as follows:
Clause 1, Article 31 of the Law on Civil Servants stipulates the principles for appointing professional titles for civil servants as follows:
"Working in a job position must be appointed to the professional title corresponding to that job position" and "A person appointed to a professional title must meet the standards of that professional title".
In case Ms. Le Thao has not been transferred to the professional title of junior high school teacher, she will discuss with the head of the public service unit to request the competent authority to decide on the transfer of professional title according to the provisions of Article 30 of Decree No. 115/2020/ND-CP dated September 25, 2020 of the Government regulating the recruitment, use and management of civil servants and ensuring the principles prescribed in Clause 5, Article 5 of Circular No. 08/2023/TT-BGDDT.
In case Ms. Thao has been transferred to the professional title of junior high school teacher, it is recommended that the competent authority appointing the professional title of junior high school teacher base on the provisions of Article 7 of Circular No. 03/2021/TT-BGDDT dated February 2, 2021 of the Minister of Education and Training stipulating codes, professional title standards and appointment, salary classification of teaching staff in public junior high schools, which has been amended and supplemented in Clause 8, Article 3 of Circular No. 08/2023/TT-BGDDT dated April 14, 2023 of the Minister of Education and Training to transfer the ranking of the professional title of junior high school teacher accordingly.
