Sending questions to the Ministry of Education and Training, Ms. Trinh Hai Yen said that on June 8, 2015, she received a decision to recruit civil servants from the People's Committee of Hoa Binh province, who are teachers at a high school.
On July 1, 2016, she was recognized for completing her probation period and appointed to the professional title of High School Teacher, code 15.113.
On October 30, 2016, she received a decision to transfer to a primary school in Quoc Oai district, Hanoi City, and was then appointed to the professional title of Primary Teacher, grade II, code V.07.03.07 from March 27, 2017.
On April 1, 2021, after considering transferring professional titles, due to the lack of a professional title certificate for Primary Teacher, rank II, she was appointed to the position of Primary Teacher, rank III, code V.07.03.29.
After that, she supplemented her vocational title certificate of Primary Teacher, grade II, completed and was granted the certificate on June 11, 2021.
Ms. Yen asked, with 4 years of excellently completing tasks, 1 second prize and 1 third prize for excellent teachers, 3 district-level initiatives recognized and many years of students participating in competitions winning high prizes, is your case considered for transferring to a secondary school teacher rank II, is it considered at the present time?
The Ministry of Education and Training answers this question as follows:
On August 14, 2023, the Ministry of Education and Training issued Official Dispatch No. 4306/BGDDT-NGCBQLGD guiding a number of contents related to the appointment of vocational titles in preschool and general education.
Accordingly, point a, section 1.1, clause 1 of Official Dispatch No. 4306/BGDDT-NGCBQLGD has guided on regulations on training certificates according to professional title standards when appointing corresponding professional titles and transferring professional titles as follows:
a) When appointing and transferring professional titles of preschool, primary, and secondary school teachers from Joint Circulars No. 20/2015/TT-BGDDT-BNV, 21/2015/TT-BGDDT-BNV, 22/2015/TT-BGDDT-BNV to corresponding professional titles according to the provisions of Circulars No. 01/2021/TT-BGDDT, 02/2021/TT-BGDDT, 03/2021/TT-BGDDT and Circular No. 08/2023/TT-BGDDT, it is only based on training qualification standards and time holding lower ranks adjacent, not requiring teachers to have a training certificate according to the professional title standards of the appointed rank.
b) When implementing the transfer of professional title rank for cases where teachers have not been appointed to professional titles in accordance with the teaching level or change job positions, the professional title being held is not suitable for the requirements of the new job position and does not require teachers to have a certificate of training according to the professional title standards of the transferred job position.
c) After being appointed or transferred to a professional title, if teachers have a need to register for the exam or consider promotion to a higher professional title immediately preceding them, they must have a training certificate according to professional title standards as prescribed".
At the same time, the appointment of the professional title of Primary Teacher of Grade II is carried out according to the provisions of Article 7 of Circular No. 02/2021/TT-BGDDT, which has been amended and supplemented in Clause 7, Article 4 of Circular No. 08/2023/TT-BGDDT as follows:
Appointment to the professional title of Primary Teacher Grade II (code number V.07.03.28) for Primary Teacher Grade II (code number V.07.03.07) with a total time holding the professional title of Primary Teacher Grade III (code number V.07.03.08) and Grade II (code number V.07.03.07) or equivalent from full 09 (nine) years or more (excluding probation period)".
The determination of the time to hold equivalent professional titles is carried out according to the provisions of Article 13 of Circular No. 13/2024/TT-BGDDT.
The Ministry of Education and Training noted that if the conditions are met according to regulations, Ms. Yen will provide documents proving the working process and holding professional titles for the principal so that the principal can request the competent authority to appoint the professional title of Primary Teacher of Grade II (code number V.07.03.28).
