Clause 3, Article 14 of Decree 04/2021/ND-CP stipulates violations of examination regulations as follows:
Fines for violations of examination regulations are as follows:
Fines from VND 1,000,000 to VND 2,000,000 for entering the examination or grading area without permission; bringing documents, information, or items not permitted into the examination room or grading area;
Fine from 2,000,000 VND to 6,000,000 VND for the act of taking the test for a candidate or helping a candidate take the test;
A fine of VND 6,000,000 to VND 8,000,000 shall be imposed for the act of writing additional or correcting test content or correcting test scores in violation of regulations but not to the extent of criminal prosecution;
Fine from 8,000,000 VND to 12,000,000 VND for the act of swapping exam papers but not to the extent of criminal prosecution;
Fines from VND 12,000,000 to VND 14,000,000 for the act of organizing exam grading in violation of regulations but not to the extent of criminal prosecution;
Fine from 14,000,000 VND to 16,000,000 VND for taking an exam on behalf of or accompanying someone else or asking someone else to take the test or take the exam on behalf of or accompanying someone else.
According to Point b Clause 3 Article 3 of Decree 04/2021/ND-CP supplemented by Point b Clause 1 Article 1 of Decree 127/2021/ND-CP, the fine level is stipulated as follows:
The fines prescribed in Chapter II of this Decree shall be applied to administrative violations by organizations, except for the provisions in Clause 5, Article 9, Clause 2, Article 11, Clause 1 and Points a, b, c, d, e, Clause 3, Article 14, Point b, Clause 3, Article 21, Clause 1, Article 23, Clause 1, Article 29 of this Decree which are fines for administrative violations by individuals. For the same administrative violation, the fine for an individual is one-half of the fine for an organization.
Thus, according to the above regulations, in addition to being disciplined at school, you will also be subject to administrative penalties. If you ask someone else to take the exam for you, you and the person who helps you will each be fined from 14,000,000 VND to 16,000,000 VND.
Pursuant to Article 9 of Circular 10/2016/TT-BGDDT, disciplinary measures for students who commit violations are prescribed. Accordingly, depending on the nature, severity, and consequences of the violation, students may be warned, criticized, or subject to one of the following disciplinary measures:
Reprimand: Applied to students who commit a first-time violation but at a minor level.
Warning: applied to students who have been reprimanded but re-offend or commit minor violations but the violations are frequent or first-time violations but the violations are relatively serious;
Temporary suspension from study: Applies to students who are on warning but still violate discipline or seriously violate the acts that students are not allowed to do; students who violate the law and are sentenced to prison but given a suspended sentence. Depending on each specific case, the Head of the higher education institution shall base on the training regulations to decide the duration of suspension from study according to the following levels: Suspension for one semester, suspension for one academic year or suspension according to the time the student is sentenced to prison but given a suspended sentence.
Forced expulsion: Applicable to students who are suspended from school and continue to violate discipline or commit a first-time violation but the nature and level of the violation are especially serious, causing negative impacts on the university and society; violating the law and being punished with imprisonment.
Disciplinary measures of students from warning and above must be recorded in the student management file and notified to the student's family. In case a student is disciplined with a temporary suspension or forced to leave school, the higher education institution must send a notice to the locality and the student's family to coordinate management and education.
Specifically, students who ask others to take the exam for them or take the exam for them will be subject to the following penalties:
1st Violation: Temporary Suspension
Second offense: Forced to leave school
