How much time do principals and vice principals spend to teach extra classes?
According to Decree 115/2020/ND-CP, the concept of management civil servant is clearly stated as follows:
Management officials are those appointed to hold management positions for a limited period of time, responsible for operating and organizing the implementation of one or more tasks in public service units and entitled to management position allowances.
Accordingly, from July 1, 2020, the Law on Cadres, Civil Servants and the Law on Public Employees 2019 have been amended and supplemented and come into effect. Accordingly, Principals and Vice Principals of public schools are no longer civil servants but are considered management officials.
According to current legal documents, current civil servants (including Principals and Vice Principals) are generally classified as civil servants according to grades I, II, III with codes V.07.
Principals and Vice Principals are management officials and receive position allowances, so the current working hours are regulated to be 40 hours/week.
According to regulations, the task has been carried out for 40 hours/week, so principals and deputy principals who want to teach extra classes are not allowed to teach during office hours, if they teach extra classes and collect money during working hours, it is not in accordance with regulations.
Who should the principal report to when teaching extra classes?
Clause 3, Article 6 of Circular 29 on extra teaching and learning stipulates extra teaching outside of school. Accordingly, teachers who want to teach extra classes must report as follows:
Teachers who are teaching at schools participating in extra-curricular teaching must report to the Principal or Director or head of the school (hereinafter referred to as the Principal) about the subjects, location, form, and time of participation in extra-curricular teaching (according to Form No. 03 in the Appendix to this Circular).
According to this clause 3, Vice Principals who need to teach extra classes are the same as teachers who have to report to the Principal about the above regulations.
However, for the Principal, there are currently no specific regulations on who the principal should report to if he wants to participate in extra teaching outside of school.
