Ms. Ly Phuong Hoa was a high school contract teacher from September 2012 to July 2017, not continuous and has not received social insurance (contract period is 4 years and 9 months).
In August 2020, Ms. Hoa passed the civil service exam and did not have to do an internship. Now that the locality where Ms. Hoa works has a document reviewing the promotion of teachers, Ms. Hoa asked, how is her time holding the rank to consider promotion calculated? At the time of considering the promotion, if she has worked for 9 years and 4 months, is she eligible for consideration for promotion to the rank of Grade II High School Teacher?

The Ministry of Education and Training responded to this issue on the Government Electronic Information Portal as follows:
The standards and conditions for considering promotion to the professional title of Grade II High School Teacher (code V.07.05.14) are implemented according to the provisions of Article 9 of Circular No. 13/2024/TT-BGDDT. In which, the standards and conditions for the duration of holding the rank prescribed in Clause 5, Article 9 are as follows:
" Meeting the requirements for the duration of holding the professional title of Grade III High School Teacher (including the duration of holding the equivalent rank) as prescribed in Clause 4, Article 4 of Circular No. 08/2023/TT-BGDDT.
In case the teacher before being recruited or accepted has worked in accordance with the provisions of law and has paid compulsory social insurance, it shall comply with the Government's regulations in Point d, Clause 1, Article 32 of Decree No. 115/2020/ND-CP, which has been amended and supplemented in Clause 16, Article 1 of Decree No. 85/2023/ND-CP".
Thus, the working time of Ms. Ly Phuong Hoa in accordance with the provisions of law, with compulsory social insurance contributions as prescribed in Point d, Clause 1, Article 32 of Decree No. 115/2020/ND-CP, amended and supplemented in Clause 16, Article 1 of Decree No. 85/2023/ND-CP, is counted as working time equivalent to the time holding the professional title of Grade III High School Teacher.
In addition, in addition to the standards and conditions for the time of holding the rank, there are other standards and conditions (classification of assessment results, classification of civil servant quality; training and fostering qualifications; capacity and professional standards).
Ms. Hoa is requested to provide evidence according to the regulations on standards and conditions in Article 9 of Circular No. 13/2024/TT-BGDDT to the competent authority for considering promotion of professional titles in the locality to determine the level of eligibility for standards and conditions for considering promotion of professional titles of Grade II High School Teachers.
