Speaking at the Conference to collect opinions on the draft Law amending and supplementing a number of articles of the Commercial Law, Competition Law, Foreign Trade Management Law, and Law on Protection of Consumer Rights held on March 6, Mr. Trinh Anh Tuan, Chairman of the National Competition Committee, said that in the context of the country entering a new stage of development, in 2025, the Politburo issued 4 key Resolutions (Resolutions 57, 59, 66 and 68) to create breakthrough development for the country.
These Resolutions form a synchronous system, focusing on core areas such as: Institutions, technology and economic sectors to bring Vietnam to realize its aspiration for strong development.
Next, on September 26, 2025, the National Assembly Standing Committee issued Resolution No. 105 on the 2026 Legislative Program, which includes the draft Law amending and supplementing a number of articles of the Commercial Law, Competition Law, Foreign Trade Management Law, Law on Protection of Consumer Rights (hereinafter referred to as the draft law) into the program. This draft law is expected to be submitted to the National Assembly for consideration and approval in October 2026.
On October 24, 2025, the Prime Minister issued Decision No. 2352 assigning the Ministry of Industry and Trade to preside over, build and submit the draft law in accordance with the schedule and authority. This is a specific step to implement the Law-Making Program, and at the same time, demonstrates the Government's determination to complete the legal framework and market practice.
The development of the draft law is placed in the context that our country is promoting the completion of the socialist-oriented market economy institution, drastically implementing the policy of arranging and streamlining the organizational structure, strengthening decentralization and delegation of power associated with power control, improving the efficiency and effectiveness of state management. The project aims to fully institutionalize the Party's guidelines, especially the requirement to innovate the work of building and implementing laws, remove institutional bottlenecks, ensure the synchronization and unity of the legal system, and at the same time meet the requirements of international economic integration and the strong development of e-commerce and new business models" - Mr. Trinh Anh Tuan said.
Based on a comprehensive review, Mr. Trinh Anh Tuan said that the draft law focuses on two major policy groups.
First, policies on promoting decentralization and delegation of power associated with administrative procedure reform and business investment conditions. Accordingly, some state management powers such as: The power to license processing of goods, serving export and import according to licenses are proposed and will be decentralized from the Ministry and the Provincial People's Committee, ensuring the motto "locality decides, locality does, locality takes responsibility". At the same time, reducing compliance costs and processing time for businesses.
Second, policies must remove difficulties and obstacles caused by law, including legalizing the concept of counterfeit goods in the Commercial Law, perfecting the mechanism for self-certifying the origin of goods, supplementing and clarifying prohibited acts in the field of competition, perfecting the mechanism for handling violations of competition law and strengthening the protection of consumers' legitimate rights and interests in the digital environment.
These policies are built on the viewpoint of ensuring the constitutionality, legality, and synchronous unity of the legal system, in accordance with international treaties to which Vietnam is a member, and at the same time, a reasonable balance between state management requirements and the freedom of business of enterprises.
The conference is organized with the desire to listen to multi-dimensional, frank and responsible contributions from management agencies, experts, the business community, and social organizations. We especially hope to receive profound opinions on the scope of adjustment, feasibility of policy options, impact on the competitive environment, export activities and consumer rights; proposals to improve legislative techniques. The opinions at the conference will be summarized, researched, and absorbed to the maximum extent by the drafting team to complete policy documents, ensuring quality progress according to the requirements of the Government and the National Assembly" - Mr. Trinh Anh Tuan emphasized.
