Business household owned by Ms. N.T.D (born in 1994, residing in Phu Tho).
The inspection team determined that in addition to the registered business address, the above business household used an additional location with number 43 located in the 31ha urban area, Trau Quy (Gia Lam, Hanoi) as a warehouse for storing goods and assembling products. This location has not been notified to the competent authority.
At the time of inspection, the authorities recorded dozens of semi-finished 3-wheel and 4-wheel electric vehicles lined up in an area of hundreds of square meters, with many brands such as Goda Pro, Me leisure, Fishion, Dilly, Wanyuan...
At the time of inspection, the representative of the business household presented to the inspection team the Business Registration Certificate issued by the Department of Finance - Planning, Gia Lam District People's Committee with 4 main business lines, including: wholesale and retail of motorbikes and electric motorbikes; wholesale of bicycles and bicycle parts; retail of bicycles and bicycle parts; wholesale and retail of electric motorbike and motorbike parts.
For products on sale, business representatives cannot present invoices and documents proving the legality of the goods.
Checking on e-commerce platforms, the Inspection Team discovered that many types of goods at the Business Household were introduced on the website: xedienmanhphat.vn.
Although it has an online ordering function, this website has not yet notified the competent state management agencies. On the TikTok platform, the account Xe dien M.P (abbreviated name) also posted many videos introducing the products that the authorities inspected at the business location. This account has over 200,000 followers and more than 3.3 million likes. Each post attracts thousands to hundreds of thousands of interactions.
In actual counting, the Inspection Team conducted procedures to temporarily detain 25 3-wheel and 4-wheel electric vehicles, with the value of infringing goods exceeding 500 million VND for handling according to regulations.
According to information in Resolution No. 05/2008/NQ-CP of the regular Government meeting in January 2008 issued by the Government on February 4, 2008, it is clearly stated that no new licenses will be granted for the circulation of additional types of 3-wheeled motor vehicles.
For existing three-wheeled motor vehicles in circulation, regulations are issued to prohibit their circulation (including imported three-wheeled motor vehicles) in inner cities, towns and national highways. In particular, homemade vehicles used as means of transport for war invalids and disabled people (not carrying additional people and goods) are allowed to circulate until December 31, 2008.
Therefore, it can be understood that driving three-wheeled vehicles is not allowed in Vietnam, except in special cases. Driving a motor vehicle that does not meet technical safety and environmental protection standards may be subject to administrative penalties or criminal prosecution depending on the act and the consequences.
