The Ministry of Home Affairs is finalizing the Draft Resolution of the Government on policies and regimes for people working at the Military Command (CHQS) of communes, wards, and special zones who quit their jobs due to the reorganization of the Military Command of communes, wards, and special zones according to Resolution No. 66/12/2026/NQ-CP dated January 26, 2026 of the Government.
According to the draft submission of the Ministry of Home Affairs, implementing Conclusion No. 228-KL/TW dated December 30, 2025 of the Politburo, the Ministry of National Defense has chaired and coordinated with relevant ministries, branches and localities to submit to the Government for promulgation Resolution No. 66/12/2026/NQ-CP dated January 26, 2026 on the organization and operation of the Military Commands of communes, wards, and special zones.
Up to now, the Ministry of National Defense and localities have actively coordinated to implement the arrangement and consolidation and arrangement of standing officers to hold positions of the Commune-level Military Command according to the Government's Resolution and the provisions of the Law amending and supplementing a number of articles of 11 Laws on military and national defense.
However, according to reports from localities, so far there are still a few cases waiting for consideration for arrangement or consideration for dismissal due to not meeting sufficient standards of age, training level according to job position requirements in the locality, and health.
The Ministry of Home Affairs believes that it is necessary to submit to the Government for promulgation a Resolution on policies and regimes for people working at the Military Commands of communes, wards, and special zones who quit their jobs due to the reorganization of the Military Commands of communes, wards, and special zones according to Resolution No. 66/12/2026/NQ-CP dated January 26, 2026 of the Government.
According to the Ministry of Home Affairs, based on the compilation of data reported by localities, there are a total of 83 cases nationwide expected to quit their jobs.
Based on the provisions of Decree No. 154/2025/ND-CP, Article 4 of the draft Resolution stipulates that the settlement of policies and regimes for subjects specified in this Resolution shall be implemented as prescribed in Decree No. 154/2025/ND-CP.
However, to ensure the rights of these subjects before resigning, the draft Resolution specifically stipulates a number of cases.
In which, the Ministry of Home Affairs mentioned cases where Commune-level Military Deputy Commanders and Commune-level Military Assistants have not been identified as not meeting the standards for appointment to civil servants according to Law No. 98/2025/QH15.
According to reports from localities, there are 15 cases nationwide, of which 10 people receive monthly allowances from non-specialized workers and 5 people receive according to salary scales and ranks.
Therefore, to fully cover the monthly salaries and allowances of subjects, the draft Resolution stipulates: "For subjects entitled to policies specified in Clause 2, Article 4 of this Resolution, the current monthly salary or allowance to calculate allowances is the current monthly salary or allowance of the month immediately preceding the dismissal".
