Mr. Nguyen Van Duy (name of the character has been changed) said that before being recruited into the civil service with the title of Commander of the Military Command of the commune level in November 2023, he had been working since July 2018 in the position of Deputy Commander of the Military Command of the commune and participated in compulsory social insurance (BHXH).
He has a college degree in Military Science at a formal institution, suitable for his job position.
However, when recruited as a civil servant in 2023, the functional agency did not add up the time he had contributed to social insurance before to serve as a basis for ranking and salary coefficient.
Therefore, Mr. Duy requested the Ministry of Home Affairs to guide whether the social insurance contribution period before recruitment is considered for salary ranking or not, according to the provisions of Decree 138/2020/ND-CP and Decree 33/2023/ND-CP, especially Clause 3, Article 16 of Decree 33/2023/ND-CP.
Answering this content on the Electronic Information Portal, the Ministry of Home Affairs said that on September 9, 2025, it issued Official Dispatch 7644 sent to the People's Committees of provinces and cities on the recruitment and salary ranking of commune-level military commanders, deputy commanders, and assistants.
In case salaries are currently ranked according to the professional and nghiệp vụ salary scale of civil servants and public employees specified in Decree No. 204/2004/ND-CP, they will continue to receive salaries according to the rank and grade already ranked.
In case salaries are being ranked according to the salary scale of military ranks of officers of the People's Army; officers, non-commissioned officers of the People's Police and cipher or are being ranked according to the salary scale of professional soldiers of the People's Army and technical expertise of the People's Police or according to salary scales for cipher officers, it shall be implemented corresponding to each case according to the guidance in Clause 6, Clause 7 Section III of Circular No. 79/2005/TT-BNV7.
In cases that do not fall into the above 2 cases, the calculation method in point a, clause 10 of Circular No. 79/2005/TT-BNV shall be implemented.
Accordingly, based on the working time in accordance with the law, in accordance with the professional qualification requirements of the positions of Commander, Deputy Commander, Assistant to the Military Command of the commune level (new), with compulsory social insurance contributions (if not continuously but have not received a one-time social insurance allowance, it is accumulated), classified into the salary grade in the specialist - civil servant rank A1 (if having university degree) or civil servant rank A0 (if having college degree) specified in the Professional and nghiệp vụ Salary Table for cadres and civil servants in state agencies (Table 2) issued together with Decree No. 204/2004/ND-CP.
The principle of calculation is that from grade 1, every 3 years (full 36 months) it is ranked to 1 salary grade;
After converting the time to be ranked into the salary grade in the civil servant rank, if there are months that are not enough 36 months, these months are counted into the time for considering salary grade promotion next time or considering enjoying seniority allowance beyond the frame (if any).
