Deputy Prime Minister Pham Thi Thanh Tra has just signed and promulgated Decree No. 361/2025 of the Government regulating civil servant positions, effective from December 31, 2025.
The list of job positions is determined according to the lists issued with the Decree, including 5 groups.
In which, 89 positions of leadership and management civil servants in agencies and administrative organizations at the ministry and at the provincial level; 690 positions of professional and nghiep vu civil servants in agencies and administrative organizations at the ministry and at the provincial level; 22 positions of supporting and serving civil servants in agencies and administrative organizations at the ministry and at the provincial level; 28 positions of civil servants in the Office of the National Assembly Delegation and the Provincial People's Council; 45 positions of civil servants in agencies and administrative organizations at the commune level.
The Government requires the agency using civil servants to be responsible for determining the specific job positions used in their agency; building a job description and capacity framework for each job position; determining the proportion of civil servants to be assigned according to each job position in their agency or organization.
At the ministerial level, the Decree clearly states that the proportion of civil servants arranged according to job positions does not apply to positions of leading and managing civil servants who are deputy ministers and equivalents or civil servants holding senior expert positions according to the regulations of competent authorities.
Proportion of civil servants arranged according to job positions ranked as senior specialists and equivalents:
For Departments and equivalents that are organizations performing in-depth advisory functions on state management for each field: A rate not exceeding 40% of the total staffing of the unit assigned by competent authorities. For Departments and equivalents that are organizations performing general advisory or advisory functions on internal governance work: A rate not exceeding 30% of the total staffing of the unit assigned by competent authorities.
For type 1: The rate does not exceed 25% of the total staffing of the unit assigned by the competent authority. For type 2: The rate does not exceed 35% of the total staffing of the unit assigned by the competent authority. For the Ministry Office: The rate does not exceed 20% of the total staffing of the unit assigned by the competent authority.
Proportion of civil servants arranged according to job positions ranked as main specialists and equivalents:
For Departments and equivalents, which are organizations performing in-depth advisory functions on state management for each field: The rate does not exceed 40% of the total staffing of the unit assigned by competent authorities.
For Departments and equivalents that are general advisory organizations or advisory organizations on internal governance work: A rate not exceeding 50% of the total staffing of the unit assigned by competent authorities;
At the provincial and commune levels, the proportion of civil servants arranged according to job positions ranked as senior specialists and equivalents:
For leadership and management positions as heads of specialized agencies under the province: The rate is 100%. For leadership and management positions as deputy heads of specialized agencies under the province: The rate does not exceed 50% of the total number of deputy heads of all specialized agencies under the province according to the regulations of competent authorities.
Proportion of civil servants arranged according to job positions ranked as main specialists and equivalents:
For specialized agencies under the province: The rate does not exceed 50% of the total civil servant payroll of each specialized agency under the province assigned by competent authorities.
For specialized agencies under communes: the leadership and management position is the head of specialized agencies under communes, the rate is 100%.
For leadership and management positions that are deputy heads of specialized agencies under communes, the rate does not exceed 50% of the total number of deputy heads of all specialized agencies under communes according to the regulations of competent authorities.
