The Ministry of Public Security is seeking comments on the draft Circular regulating the implementation of inspection conclusions of the People's Public Security force (CAND).
The Ministry of Public Security said that the work of the People's Public Security Inspectorate plays a very important role in performing the state management function of national security, ensuring social order and safety, and is a method of promoting democracy, strengthening socialist legality, preventing, detecting and handling violations of the law.
The development and promulgation of a Circular regulating the implementation of inspection conclusions by the People's Public Security Forces (replacing Circular No. 29/2019/TT-BCA) is necessary and suitable to practice, contributing to perfecting the legal basis, creating unity and synchronization in the implementation of inspection conclusions and post-inspection handling, contributing to improving the quality, effectiveness and efficiency of People's Public Security inspection work.
Basically, the provisions in the draft have inherited the provisions in Circular No. 29/2019/TT-BCA, amending and citing new provisions of the 2022 Law on Inspection.
Notably, the draft also specifically stipulates the handling of violations by Heads, Heads of agencies, units, and organizations directly managing the inspected subjects:
1. Heads, heads of agencies, units, organizations directly managing the inspected subjects (other than the People's Public Security Forces) who are cadres, civil servants, and public employees who commit violations in implementing inspection conclusions and decisions on handling inspections shall, depending on the nature and severity of the violation, be handled according to the provisions of Clause 1 and Clause 2, Article 65 of Decree No. 43/2023/ND-CP.
2. The head, head of the agency, unit, or organization directly managing the inspected subject (outside the Public Security force) who is not a cadre, civil servant, or public employee, depending on the nature and level of the violation in implementing the inspection conclusion and the decision to handle the inspection, shall be handled according to the provisions of Clause 3, Article 65 of Decree No. 43/2023/ND-CP.
3. Heads, heads of agencies, units, and organizations directly managing inspected subjects in the People's Public Security Forces who commit violations in implementing inspection conclusions and decisions on handling inspections shall, depending on the nature and severity of the violation, be subject to disciplinary action in accordance with regulations of the Ministry of Public Security.
The Ministry of Public Security said that handling violations in the implementation of inspection conclusions aims to overcome limitations in practical application, ensure deterrence for inspection subjects, police officers and soldiers as well as related agencies and organizations, and prevent violations of the law in practice.
