The Government has just issued Decree No. 177/2024/ND-CP dated December 31, 2024, stipulating the regime and policies for cases of non-re-election, re-appointment, and officials who resign or retire at will, effective from today (January 1, 2025).
At the extraordinary press conference of the Ministry of Home Affairs on the afternoon of December 31, 2024, Director of the Department of Civil Servants and Public Employees (Ministry of Home Affairs) Nguyen Tuan Ninh presented the content of Decree No. 177/2024/ND-CP.
3 subjects, 2 policies
Mr. Nguyen Tuan Ninh said: The beneficiaries of the regime and policies in Decree No. 177/2024/ND-CP include 3 groups.
The first group is not old enough to be re-elected (less than 30 months from the time of the congress to the time of retirement).
The second group, old enough to be re-elected (from 30 months to 60 months).
The third group, cadres under the management of the Politburo and Secretariat, are allowed to retire or retire by competent authorities according to Conclusion Notice No. 20-TB/KL/2022 of the Politburo.
Regarding policies and regimes, Decree No. 177/2024/ND-CP stipulates two policies: Early retirement regime and retirement leave regime.
Increase the regime compared to before and higher level of streamlining the payroll
Mr. Nguyen Tuan Ninh analyzed that the new point of the decree is that in the group of subjects not old enough to be re-elected, there are also cases of cadres who are old enough to be re-elected to the Party Committee but not old enough to be re-elected to leadership positions in the government, the Vietnam Fatherland Front (VFF), and socio-political organizations.
“The addition of the regulation aims to resolve difficulties and problems from practice. Accordingly, due to the different times of holding congresses of agencies, there are cases where people are old enough to be re-elected at the agency or organization where they work but are not old enough to be re-elected to the Party Committee,” Mr. Ninh explained.
The group that is still old enough to be re-elected is 30 - 60 months old before retirement age, but because of the arrangement of Party committee personnel, if they themselves wish to retire, according to the policy of the Politburo, the decree stipulates that there is a mechanism to encourage, motivate, and resolve the early retirement regime.
The third group of subjects enjoying the added policy are cadres under the management of the Politburo and the Secretariat who are allowed to retire or retire by competent authorities according to the Conclusion No. 20/2022 of the Politburo to create a legal basis to resolve current practices.
The Decree also adds provisions allowing the application of the regime to cases where no disciplinary action is taken but the person wishes to quit his job or retire early.
Mr. Ninh added that the regulation on handling cases of resignation or retirement before the effective date of this decree is to resolve problems with some cases of resignation or retirement in the recent past.
Notably, the decree abolishes the policy of continuing to work until retirement age to address practical issues. Because if many cases are not old enough to be re-elected but still choose to stay on the job, it will be very difficult to arrange and assign work positions. Therefore, it is necessary to encourage the regime to quit work and retire immediately.
"The policies and regimes applied to people who are not old enough to be re-elected and retire early are higher than before and are in principle higher than those for streamlining the payroll," said Mr. Ninh.
Compared to the old regulation, the new regulation increases the benefit level from 3 months of average salary to 5 months of current benefit for those who have 20 years or the first 15 years of work with social insurance contributions.
In addition, beneficiaries of this Decree's policies who are also subject to policies and regimes in the implementation of organizational restructuring may choose to enjoy higher policies and regimes.
