The Ministry of Home Affairs is seeking opinions on the Draft Law amending and supplementing a number of articles of the Law on Social Insurance.
According to the draft submission, the purpose of issuing the draft law is to amend and supplement regulations on the position, responsibilities and powers of social insurance agencies; on the responsibilities and powers of the Vietnam Fatherland Front and the Trade Union.
At the same time, the Ministry of Home Affairs also orients the amendment of the state management content of social insurance of ministries, branches and localities after implementing the organizational arrangement; on the names of ministries, branches and agencies after the organizational arrangement to ensure consistency with new regulations in the Constitution, Law on Local Government, and Law on Inspection.
One of the new points of the draft law is to add the responsibility for state management of social insurance of the Ministry of Health to Clause 2, Article 134. The Ministry of Health is an agency that assists the Government in implementing state management of social pension benefits.
The draft also amends Clause 3, Article 134 as follows: Ministries and ministerial-level agencies, within the scope of their tasks and powers, are responsible for implementing and coordinating with the Ministry of Labor, War Invalids and Social Affairs (now the Ministry of Home Affairs), the Ministry of Finance, and the Ministry of Health in implementing state management of social insurance.
The Ministry of Home Affairs also proposed to remove regulations on the responsibility for state management of social pension benefits of the Ministry of Labor, War Invalids and Social Affairs in Article 136.
The contents of state management of the Ministry of Home Affairs will be abolished such as: Developing and submitting to competent authorities to issue or promulgate according to its authority policies and laws on social pension benefits; Propagating, disseminating and educating laws on social pension benefits; Directing and guiding the implementation of policies and laws on social pension benefits; Inspecting, inspecting, handling violations of the law, resolving complaints and denunciations about social pension benefits.
At the same time, the draft law is proposed to add Article 137a on the responsibility of the Ministry of Health in state management of social pension benefits.
