Ms. Nguyen Thi Lien (character's name has been changed) learned about Clause 1, Article 70 of Decree No. 170/2025, which stipulates: "In case the first round of recruitment process has been completed before the effective date of this Decree, recruitment will continue to be carried out according to the provisions of current law for a period of 3 months from the effective date of this Decree; in case it is not completed within 3 months, the recruitment period will be canceled".
Gia Lai province has organized civil servant recruitment in 2024 and completed the second round on November 25, 2024. However, up to now, the Provincial People's Committee and the Department of Home Affairs have not yet announced the approval of the recruitment results, because they have not received specific instructions from the Ministry of Home Affairs.
"We hope that the Ministry will soon issue a document guiding the province to have a basis for implementation, ensuring legitimate rights for the candidates who have been suspended from December 2024 to present" - Ms. Lien proposed.
Regarding Ms. Lien's reflection and recommendation, the Ministry of Home Affairs responded on the Electronic Information Portal.
Pursuant to the Law on Cadres and Civil Servants 2025, the Government issued Decree No. 170/2025 on recruitment, use and management of civil servants, in which Article 70 stipulates transition for cases that have carried out the recruitment process before the effective date of this Decree.
Accordingly, in case the first round of recruitment process has been completed before the effective date of this Decree, recruitment will continue to be conducted according to the provisions of current law within 3 months from the effective date of this Decree; in case it is not completed within 3 months, the recruitment period will be canceled.
No later than July 1, 2027, ministries, branches, central and local agencies must complete the arrangement to job positions and rank them according to job positions for civil servants recruited before the effective date of the 2025 Law on Cadres and Civil Servants under their management according to regulations.
During this time, civil servants who are assigned to the position of a civil servant in leadership and management will be assigned to the corresponding rank without the requirement to have a certificate of training in state management knowledge and skills.
In case the competent authority issues a document regulating personnel work with a pilot content or content other than the provisions of current law, it shall comply with the new regulations of the competent authority.
From July 1, 2025, people who are performing the probationary regime according to the provisions of the Law on Cadres and Civil Servants No. 22/2008/QH12, have been amended and supplemented with a number of articles according to Law No. 52/2019/QH14, and are classified as civil servants corresponding to the recruitment job position.
The comments and evaluation of the probationary period before July 1, 2025 are carried out in accordance with the provisions of Decree No. 138/2020 amended and supplemented in Decree No. 116/2024 of the Government amending and supplementing a number of articles of Decree No. 138/2020 regulating the recruitment, use and management of civil servants and Decree No. 06/2023 dated February 21, 2023 regulating the quality control of civil servant input.
In case the competent authority evaluates and comments that do not meet the requirements (only applicable to those with an internship period of 6 months or more as of June 30, 2025), the recruitment decision shall be canceled according to regulations.
