On July 12, the Government Office issued Official Letter No. 6388/VPCP-CN on the selection of contractors for the Ho Chi Minh City (HCMC) - Thu Dau Mot - Chon Thanh Expressway construction package through Binh Phuoc province.

Considering the report of the Ministry of Finance (Document No. 10038/BTC-QLDT dated July 5, 2025) on the report on the results of the inspection of the selection of contractors for the construction package of the Ho Chi Minh City - Thu Dau Mot - Chon Thanh expressway project through Binh Phuoc province (now Dong Nai province), Deputy Prime Minister Tran Hong Ha commented as follows:
Assign the People's Committee of Dong Nai province to accept the opinion of the Ministry of Finance in the above document, direct the handling in accordance with legal regulations on bidding to ensure the selection of competitive, transparent, effective contractors, combating negativity and group interests.
The Deputy Prime Minister requested that there should be no delays or prolongations in the time of contractor selection, affecting the progress and quality of the project package; report to the Prime Minister on the implementation results before July 20, 2025.
Previously, the Ministry of Finance issued Document No. 10038/BTC-QLDT reporting to the Prime Minister; Deputy Prime Minister on the results of the inspection of the selection of contractors for the construction package of the Ho Chi Minh City - Thu Dau Mot - Chon Thanh Expressway Construction Project through the old Binh Phuoc province.
Because this is a large package, with complex nature, many participating contractors and a large volume of documents and records being inspected, the inspection only focuses on reviewing the key content in the bidding documents, the results of the bidding document assessment directly related to the contractor's recommendations and the contents under the direction of the Deputy Prime Minister in Document No. 4755/VPCP-CN.
Regarding the case of Son Hai Group's failed bidding, the Ministry of Finance recommended that the Government assign the People's Committee of Dong Nai province to inspect and review the contractor selection process.
This is the second report of the Ministry of Finance related to this incident. Previously, Deputy Prime Minister Tran Hong Ha requested this agency to review and report back on the process of selecting the project contractor, due to incomplete content.
Based on the results of this inspection, the Ministry of Finance recommends that the Government leaders direct Dong Nai to review and re-evaluate the entire process of selecting contractors, overcoming shortcomings and errors. If necessary, the province needs to select another consulting unit with capacity and experience to do this.
After re-evaluating the electronic bidding documents (E-HSDT), there may be 2 cases.
In case 1, re-evaluate the E-HSDT dossier, changing the unit proposed to win the bid or all participants do not comply, the competent person implements the measure of "not recognizing the results of contractor selection". At the same time, localities must consider and handle organizations and individuals who violate (if any). On that basis, the investor will take the next steps including canceling the bid to re-organize the auction or re-approve the selection results.
In case 2, if the assessment does not change the results of contractor selection, the investor needs to quickly complete and sign a contract with the winning bidder.
The Ministry of Finance notes that in all cases, selected contractors must meet the requirements of capacity, experience, technical solutions, finance, quality, and implementation progress, while not allowing loss, waste, or negativity.
