Mr. Nguyen Van Anh (name of the character changed) said that according to point d, clause 1, Article 3 of Circular No. 08/2013/TT-BNV of the Ministry of Home Affairs, achievements for consideration of early salary promotion due to outstanding achievements are determined at the time of issuing the decision recognizing achievements, in the last 6 years for ranks and titles requiring qualifications from college or higher and the last 4 years for ranks and titles requiring qualifications from intermediate level or lower, as of December 31 of the year of consideration for early salary promotion.
The Circular also stipulates that in cases where salary grades have been increased ahead of schedule, all achievements achieved before the date of the decision to increase salary grades ahead of schedule within the above period will not be counted for consideration of salary grade increase ahead of schedule for the next time.
From this regulation, Mr. Nguyen Van Anh requested the Ministry of Home Affairs to clarify the concept of "date of early salary increase decision" to be understood as the date of issuance of the decision or the date used as a milestone to calculate early salary increase, in order to ensure uniform application in practice.
Regarding your reflection and proposal, the Ministry of Home Affairs has responded on the Electronic Information Portal.
Accordingly, the regime of early salary increase is specifically guided in Article 3 of Circular No. 08/2013/TT-BNV dated July 31, 2013 of the Minister of Home Affairs guiding the implementation of the regime of regular salary increase and early salary increase for cadres, civil servants, public employees and employees (amended and supplemented in Circular No. 03/2021/TT-BNV dated June 29, 2021 of the Minister of Home Affairs).
In which, point d, clause 1, Article 3 stipulates: "Regarding cases where salary grades have been increased ahead of schedule, all achievements achieved before the date of the decision to increase salary grades ahead of schedule in the period (6 years and 4 years) specified in this Point are not counted for consideration of salary grade increase ahead of schedule for the next time" are counted from the date of issuance of the Decision.
The organization of policy implementation for cadres, civil servants, and public employees in Tay Ninh province is under the authority of the Chairman of the Provincial People's Committee.
Therefore, the Ministry of Home Affairs has requested him to contact the agency managing cadres, civil servants, and public employees of Tay Ninh province (Department of Home Affairs) for answers.
