Ministry of Home Affairs sets conditions for exemption from probation for re-employed teachers

According to the Ministry of Home Affairs, re-employed teachers may be exempted from probation if they meet the conditions on working time and social insurance contributions as prescribed.

Mr. Nguyen Van Huy (name of the character changed) said that he worked as a primary school physical education teacher from 2011 to 2022, has a college degree and is classified under professional title V.07.03.08. Due to family circumstances, he resigned and has not received social insurance (BHXH) once.

In 2025, after completing his university program, he participated in the entrance exam and was re-admitted to the position of primary physical education teacher, code V.07.03.29.

Mr. Huy wondered, with 11 years of work and previous social insurance contributions, and continuing to take on the correct professional and nghiệp vụ he had previously undertaken, will he be exempt from implementing the probationary regime or not? In case of being re-recruited, how will the appointment of professional titles and salary ranking be implemented?

Regarding his proposal, the Ministry of Home Affairs has responded on the Electronic Information Portal.

According to Clause 5, Article 21 of Decree No. 115/2020/ND-CP dated September 25, 2020 (amended and supplemented in Decree No. 85/2023/ND-CP dated December 7, 2023) of the Government on recruitment, use and management of public employees, cases of being recruited into public employees do not have to implement probationary regimes if they meet all the conditions specified in the above Decree.

Accordingly, the probationary regime is not implemented for cases that have had a period of working with compulsory social insurance contributions in accordance with the provisions of the Law on Social Insurance, are arranged to work according to the correct training major or according to the correct professional qualifications previously undertaken, and the period of working with social insurance contributions (if interrupted, it is accumulated) is equal to or greater than the probationary period corresponding to the probationary period of the professional title recruited specified in Clause 2 of this Article.

For cases that do not implement the probationary regime, the head of a public non-business unit must send civil servants to participate in training courses to complete the standards and conditions of the professional title of civil servant before appointment.
