Proposal for policies for militia and self-defense forces according to the basic salary level

The Ministry of National Defense has just received voters' recommendations on the policy for militia and self-defense forces according to the basic salary level.

On March 28, according to the Ministry of National Defense's Electronic Information Portal, the Ministry of National Defense received a petition from voters in Quang Nam province sent by the Petition Committee.

Accordingly, voters of Quang Nam province recommended that currently, the regimes, policies, and support levels for militia and self-defense forces according to Decree No. 72/2020/ND-CP dated June 30, 2020 of the Government detailing a number of articles of the Law on Militia and Self-Defense are regulated with specific amounts of money (not according to coefficients) that do not ensure the rights of militia and self-defense forces when the Government adjusts the new basic salary. The Government is requested to promptly amend and supplement the provisions in Decree No. 72/2020/ND-CP to suit (it is not recommended to stipulate specific fees).

Responding to this content, the Ministry of National Defense said that on February 4, 2025, the Government issued Decree No. 16/2025/ND-CP amending and supplementing a number of articles of Decree No. 72/2020/ND-CP dated June 30, 2020 of the Government detailing a number of articles of the Law on Militia and Self-Defense Forces on organization and construction of forces and regimes and policies for militia and self-defense forces.

The content of Decree No. 16/2025/ND-CP has adjusted the level of enjoyment of the regime and policies of the militia and self-defense force and the norms to ensure the regime and policies for the title of militia and self-defense force; stipulates that the agency is responsible for ensuring funding, regimes and policies for militia and self-defense forces not participating in social insurance and health insurance, to comply with the legal system.

Decree No. 16/2025/ND-CP takes effect from March 23, 2025; all regimes, policies, and support levels for militia and self-defense forces are guaranteed to be implemented nationwide.

According to the Ministry of National Defense, the policy of the militia and self-defense forces is calculated based on the basic salary for cadres, civil servants, public employees and armed forces, not calculated according to the minimum monthly salary of regions according to Decree No. 38/2022/ND-CP dated June 12, 2022 of the Government stipulating the minimum salary for employees working under labor contracts.

Therefore, the policy regime calculated according to Decree No. 16/2025/ND-CP has been calculated based on the regional minimum wage multiplied by the coefficient of ensuring compliance with the new basic salary level, according to the current system of legal documents on militia and self-defense forces.
