Ms. Tran Thi Lan (character's name has been changed) is a newly recruited preschool teacher to the title of Grade III Preschool Teacher, has a university degree and has worked for 45 months with compulsory social insurance (SI) in the same position before being officially recruited.
Ms. Lan wondered: With this working process, when appointed to the professional title of civil servant, will you be paid from level 2 and count the entire 9 months of probation to level 3 of the title of Grade III Preschool Teacher?
Regarding this, according to Clause 4, Article 30 of Decree No. 85/2023 dated December 7, 2023 of the Government (amending and supplementing a number of articles of Decree No. 115/2020 dated September 25, 2020), it is clearly regulated: "When considering job title transfer, it is not combined with salary increase".
Ms. Lan's question was not about considering a change of professional title, but about appointing a new civil servant title for those with higher qualifications than the recruitment requirements and who had a previous work process (with compulsory social insurance contributions). Therefore, it is recommended that competent authorities consider and provide specific instructions according to the provisions of Decree No. 85/2023.
Regarding Ms. Lan's petition, the Ministry of Home Affairs responded on the Electronic Information Portal.
According to Decree No. 85/2023, in case the employee has a graduation certificate with a higher training level than the training level requirements of the job position, each higher training level will be added with 1 salary level.
And in case the person recruited or accepted as a civil servant according to the provisions of this Decree has previously worked in accordance with the provisions of law, and has paid compulsory social insurance (if not continuously but has not received a one-time social insurance allowance, it will be accumulated), that period will be calculated as the basis for salary classification according to professional title in accordance with the recruited or accepted job position if meeting all the prescribed conditions.
