On the afternoon of October 22, continuing the 8th Session, Chairman of the National Assembly's Committee on National Defense and Security (UBQPAN) Le Tan Toi reported on the examination of the Data Law project.
Regarding the provision of data to Party, State agencies, and socio-political organizations, Mr. Le Tan Toi said that the UBQPAN basically agrees with the provisions of the draft law. However, it is proposed to stipulate measures to ensure information security of organizations and individuals when implementing these provisions.
The National Data Development Fund is basically agreed upon by the UBQPAN to be a non-budgetary state financial fund, established at the central level to mobilize social resources to support the construction and development of national data.
There are suggestions to clarify the financial sources for forming the fund; clearly define the activities that are funded from the State budget, the activities that are funded from the fund, ensuring clarity and transparency.
There are opinions suggesting considering and clarifying the legal basis and practical basis for establishing the fund; suggesting considering the fund's expenditure contents to ensure compliance with the provisions of the law on the state budget and other relevant laws.
The UBQPAN basically agreed on the regulations on collecting, updating, and synchronizing data into the National General Database. However, there were opinions suggesting clarifying the resources to ensure the activities of collecting, updating, and synchronizing data into the National General Database.
Regarding the fee for exploiting and using information in the National Comprehensive Database and other databases managed by state agencies, the People's Committee basically agrees with the provisions in Article 39 of the draft law, aiming to create financial resources for investment and serving the construction and management of the National Comprehensive Database and other databases managed by state agencies.
There are suggestions to study and supplement regulations allowing other organizations and individuals to exploit these databases for free on the basis of contributing and providing data to these databases, in order to encourage entities to provide and share data to create a rich and complete data source.
The UBQPAN basically agrees with the regulations on products and services related to data, data markets and data exchanges in the draft law.
Mr. Le Tan Toi said that there are opinions that these are contents that are being regulated by a number of related laws such as: Law on Electronic Transactions, Law on Cyber Security, Law on Network Information Security, Law on Telecommunications and especially the draft Law on Digital Technology Industry.
Therefore, it is recommended to consider and clarify the relationship between the provisions of this draft law and the provisions of current laws and the draft Law on Digital Technology Industry to define the scope of regulation to ensure consistency and avoid overlap.
Another opinion is that this is a new and special field, in order to have strict management, ensure security and safety, it is possible to consider applying a pilot on data trading floors. Therefore, for now, it is not necessary to stipulate too much detail in this law, but to assign the Government to organize the pilot implementation and report to the National Assembly.
