This content is stipulated in Decree No. 53/2026/ND-CP dated February 5, 2026, amending and supplementing a number of articles of Decrees in the field of dikes and disaster prevention and control.
Decree No. 53/2026/ND-CP amends and supplements Articles 33, 35 of Decree No. 66/2021/ND-CP in the direction of adjusting salaries and levels according to norms specified in Decree 16/2025/ND-CP dated February 4, 2025 amending and supplementing a number of articles of Decree No. 72/2020/ND-CP detailing a number of articles of the Law on Militia and Self-Defense Forces on organizing force building and regimes and policies for Militia and Self-Defense Forces.
Regarding the salary and wage regime for people participating in shock forces mobilized for training, coaching, drills and performing disaster prevention and control tasks, Decree No. 53/2026/ND-CP stipulates newly as follows: People who do not receive salaries from the state budget during the time they are mobilized to perform disaster prevention and control tasks, participate in training, coaching, drills are entitled to a working day allowance.
The labor day allowance level is decided by the Provincial People's Committee submitting to the People's Council of the same level, but not lower than the level specified in point a, clause 1, Article 11 of Decree No. 72/2020/ND-CR detailing a number of articles of the Law on Militia and Self-Defense Forces on organization of force building and regimes and policies for Militia and Self-Defense Forces has been amended and supplemented in Decree No. 16/2025/ND-CP.
If training, drills and performing disaster prevention and control tasks at night (from 10 pm the previous day to 6 am the next day) are calculated to increase by no less than 50% of the current working day allowance level.
When training, coaching, drills, and performing disaster prevention and control tasks far from their residence, without conditions to go back and forth daily, they are arranged for accommodation, means of transportation, travel expenses, or payment for one-way train and bus fares as commune-level officials and civil servants.
Being supported with meal allowances according to the level prescribed by the Chairman of the Provincial People's Committee, but not lower than the meal allowance level specified in point b, clause 1, Article 11 of Decree No. 72/2020/ND-CR detailing a number of articles of the Law on Militia and Self-Defense Forces on organization of force building and regimes and policies for Militia and Self-Defense Forces has been amended and supplemented in Decree No. 16/2025/ND-CP.
Also according to Decree No. 53/2026/ND-CP, whichever level mobilizes, that level ensures payment.
Regarding the level of benefits for people participating in the commune-level disaster prevention and control shock force who do not participate in social insurance if they have an accident or die, Decree No. 53/2026/ND-CP is amended as follows:
In case an accident reduces labor capacity by 5% or more, it shall be implemented according to the provisions of point a, clause 3, Article 15 of Decree No. 72/2020/ND-CR detailing a number of articles of the Law on Militia and Self-Defense Forces on organization of force building and regimes and policies for Militia and Self-Defense Forces that have been amended and supplemented in Decree No. 16/2025/ND-CP.
In case of accident leading to death: Implemented according to the provisions of point b, clause 3, Article 15 of Decree No. 72/2020/ND-CР.
