Taxes of leave for civil servants who do not meet their duties

The Government requires the retirement regime for cadres and civil servants who do not meet their tasks, as a basis for recruiting commune-level cadres and civil servants.

On October 3, 2025, the Government issued Resolution No. 303/NQ-CP on solutions to effectively implement 2-level local governments according to the Conclusion of the Politburo and the Secretariat.

In the resolution, the Government requires the payment of regimes and policies for people on leave according to Decree No. 178/2024/ND-CP, Decree No. 67/2025/ND-CP no later than October 10.

Ensure financial resources, human resources and facilities for the restructuring of the apparatus, payment of regimes and policies for subjects who quit their jobs or retire early in accordance with regulations.

Report the results of payment of regimes and policies to the Steering Committee for the arrangement of administrative units at all levels and the development of a model of organizing local government at both levels (through the Ministry of Home Affairs and the Ministry of Finance) no later than October 10 for synthesis and reporting to competent authorities.

If there are any problems with legality and policies, they should immediately report to the Government (through the Government Office, Ministry of Home Affairs, Ministry of Finance) before October 5, 2025.

The Ministry of Home Affairs directly urges inspections of localities in implementing the increase of provincial-level cadres and civil servants to the commune level; presides over and coordinates with ministries and central agencies to direct and guide localities in general reviewing, evaluating, and classifying in conjunction with restructuring the team and improving the quality of commune-level cadres and civil servants after the reorganization.

Thereby, they are entitled to leave under the regime for cadres and civil servants who do not meet the requirements of the tasks, as a basis for recruiting, arranging, training, and fostering commune-level cadres and civil servants, resolving the situation of surplus and shortage, ensuring effective use of human resources; synthesizing and reviewing the implementation results before October 15.

Develop a guiding report outline for ministries and ministerial-level agencies to periodically report and send to the Ministry of Home Affairs and the Government Office at 3:00 p.m. every Monday for the Ministry of Home Affairs to synthesize and report to the Prime Minister before 3:00 p.m. every Tuesday.

The Ministry of Home Affairs coordinates with the Ministry of Finance to urge ministries, departments, branches and localities to complete the payment of regimes and policies according to the Decree amending Decree No. 178/2024/ND-CP, Decree No. 67/2025/ND-CP before October 10.

Ministries and ministerial-level agencies shall preside over and coordinate with the Ministry of Justice and relevant agencies to urgently review all legal documents to issue, amend and supplement them immediately, ensuring the overcoming of conflicts and overlaps that are not in accordance with the two-level local government model.

Especially in the fields of finance, science and technology, internal affairs, justice, agriculture and environment, construction, education and training, especially digital infrastructure and improving staff capacity, rearranging staff.

Based on the results of reviewing the feasibility of local legal documents on decentralization, delegation of authority, and division of authority, assigning ministries and ministerial-level agencies to promptly amend and supplement to facilitate the organization and operation of local government at both levels.

Ministers need to directly direct inspection, supervision, grasp the situation and organize timely and effective implementation.
