On the afternoon of July 15, the National Assembly Standing Committee gave opinions on the draft Law amending and supplementing Article 6 and Appendix IV on the List of conditional business lines of the Investment Law.
Presenting the Submission of the draft Law, Member of the Party Central Committee, Minister of Finance Ngo Van Tuan said that the draft Law adds "N2O gas business (laughing gas) for human use through the respiratory tract, outside of medical purposes" to the list of industries and occupations prohibited from investment and business.
The draft also adds "visa service business of foreign investors" to the list of conditional business lines, and at the same time removes two industries and professions from this list, including: "Procurement activities and activities directly related to the purchase and sale of goods by foreign service providers in Vietnam" and "oil and gas activities".
In the summary report of the preliminary appraisal of the draft Law, Member of the Party Central Committee, Chairman of the Economic and Finance Committee Phan Van Mai said that the majority of opinions in the Standing Committee agreed with the necessity of issuing amendments and supplements to the Law according to simplified procedures.
The Standing Committee of the Committee proposed that the drafting agency continue to review and fully explain the basis, rationality and actual effectiveness of the plan to cut conditional business lines in the draft Law.
The implementation of the goal of cutting at least 30% of conditional business lines must be substantive, contributing to improving the business investment environment and reducing compliance costs, instead of just focusing on the number of cuts.
The majority of opinions in the Standing Committee also agreed with the necessity of strengthening control and preventing the abuse of N2O gas to protect public health and ensure social order and safety.
However, many opinions suggested fully assessing the impact of the policy, clearly distinguishing prohibited acts from cases of legal use, avoiding unnecessary impacts on production and business activities and the legitimate needs of society.
Speaking at the conclusion of the meeting, Member of the Party Central Committee, Vice Chairman of the National Assembly Nguyen Hong Dien requested a comprehensive assessment of the practical basis, legal basis and policy impact on the proposal to add the business of N2O gas for human use through the respiratory tract (outside of medical purposes) to the list of prohibited investment and business lines.
At the same time, clarify the scope of regulation, clearly distinguish between prohibited acts and cases of legal use, ensuring that it does not affect production, business, research, testing, training and other legitimate professional purposes.
The Vice Chairman of the National Assembly also proposed a comprehensive review of the list of conditional business lines and industries in the spirit of putting people and businesses at the center and strongly shifting from management thinking to development creation.
The abolition of conditional investment and business lines must be fully assessed in terms of risk level, state management requirements and the ability to be replaced by other management tools.
In addition, according to the Vice Chairman of the National Assembly, it is necessary to continue to improve the mechanism of decentralization and delegation of power in investment management in the direction of strongly shifting from pre-inspection to post-inspection based on risk management.
